International Musician Maria Daines Gives Her Support to SAV

SAV are delighted to welcome on board British Rock musicians Maria and Paul who have contacted us this weekend (26th/27th April) to offer their support in the new campaign for the dogs in the Nova Pazova shelter at Stara Pazova City, Serbia.  Maria has kindly taken the trouble to write to the Mayor of the City and to the authorities in defence of the dogs currently in the shelter and who face being taken by the Shinters and destroyed in the coming days.

Maria Daines fronts a hard working no nonsense rock band playing original material written by Maria & guitarist Paul Killington. Hailing from Cambridgeshire, England, UK, they formed in 1996 becoming a fixture of the live music scene & making several TV appearances, garnering fans in over 20 countries and recently winning several awards including best artist in the International Online Music Awards 2006 & 2007.

BBC radio features tracks regularly along with FM stations world wide.  In August 2007 the band supported US artist Pink at Cardiff Arena for the Party For Animals World Wide.  The concert raised over £90,000 for six animal welfare charities.  Maria & Paul continue to work ceaselessly on the many facets of their songwriting with project pieces finding placement in TV/film production. Daines/Killington songs are published by NorthStar Music UK & available for artist consideration.

Slovenia – Brown Bears Protected by Court Action

Some Excellent news for Brown Bears in the Republic of Slovenia from:

The society for the rights and liberation of animals, Slovenia.

(Referred to as “our society” in all text following.

 

Constitutional Court of the Republic of Slovenia consented the initiative of The society for the rights and liberation of animals and nullified the execution of the brown bears.

 

Althought in Slovenia the brown bears are endangered species and therefore protected by Habitat Convention of EU as well as by slovene Decree on protected wild animal species, there was set the annual quota by the Minister of the Environment and Spatial Planning of the Republic of Slovenia in years 2005, 2006, 2007 and 2008 (Rules on the taking of brown bear (Ursus arctos) from the wild ).

 

Althought it is not known, how many bears there are in Slovenia, the Minister for example ordered to execute 75 bears in 2008, for the previous year even 100.

 

In years 2005, 2006 and 2007 there were approximately 300 bears executed, which is absurd, because we talk about the endangered species.

 

In the opinion of our Society those execution were illegal, because there weren’t given the conditions defined in Habitat Convention as well as there weren’t given conditions defined in slovene Decree on protected wild animal species for the intervention into the population of bears.

 

Intervention, as well as the execution of bears is namely acceptable if there is no alternative and if that doesn’t harm the preservation of favourable condition of the population of brown bear. Naturally, there also have to be given examples, listed in both of the previously mentioned law acts, when the intervention into he population is possible ( example: causing serious damage, assuring public health and safety, ..).  

 

According to the opinion of our Society, in Slovenia none of these conditions were given and that makes the execution of bears illiegal.

 

Because of the execution of bears in opposition to the Habitat Convention and slovene Decree on protected wild animal species, we made an initiative to Constitutional Court of the Republic of Slovenia in years 2006, 2007 and 2008 to estimate constitutionality and legality of rule, that set the annual quota of bears for execution. We also made an initiative to estimate constitutionality and legality of the Decree on changes and amendments to the Decree on protected wild animal species (OJ RS No. 84/05), that was the law basis for issuing the rule mentioned in previous sentence.

 

In initiatives, we stated number of violations of the regulations as well as the violation of the procedure of accepting both acts.

 

One of the violations we blame them for is, that the procedure of accepting both acts wasn’t in accordance with Aarhus Convention, that obliges Slovenia as well and defines the right to access to information on environment, possibility to participate in procedures of deciding and free access to means of law.   

 

Constitutional Court confirmed our reproach ( Decree no. U-I-386/06-32 dated 13th of March 2008 ). The Constitutional Court also decided that The Environment Protection Law is incompatible with slovene Constitution, because it doesn’t regulates the participation of public into the procedure of preparing sub-law regulations, that are issued in connection with protected animal specie.

 

Because of that, they also annulated Decree on protected wild animal species and Rules on the taking of brown bear (Ursus arctos) from the wild. The recall starts to produce effort 3 months after affirmation of the law, by which the slovene parliament shall abolish mentioned incompatibility between The Envoronment Protection Law and the Constitution.  

 

The efficiency of annulation of rule, that defines the execution of bears shall unfortunately be valid only in a couple of months. Many believe, that this means that in Slovenia, by that time the execution, ordered by the Minister of the Environment and Spatial Planning is still possible – Rules for 2008.  

 

According to stated, in Slovenia, there could be executed 10, 20, 30 or more bears.  

 

This is the reason why we addressed to The Government of The Republic of Slovenia, to The Minister of the Environment and Spatial Planning and to The Slovenian Hunting Association an appeal to immediately stop the execution of bears in Slovenia.

 

We believe it is illogical to use a regulation, that was recalled, inspite of the fact that the result of recalling is posponed for a while.

 

If we use a regulation, that was recalled, we could endanger the whole law structure of the state, because we believe, only incontestable general law acts can be used.

 

This means valid regulations, not recalled ones. The ones that are not incompatible with Constitution and similar. 

 

In any case it is extremely unethical to use recalled regulations whether we talk about endangered specie or not.  

 

It is becoming more and more clear, that lives of people are indivisibly connected with lives of animals and that the bad situation of animals is not in peoples’ interest.

 

It is known, that for example cattle-breeding is the biggest threat to environment and one of the largest destroyers of the climate, because emissions of harmful gases produced by cattle-breeding are much larger than emissions of the whole traffic in the world ( FAO report ).   

 

We know also, that climate changes are bigger threat to the society than for example terrorism.

 

If all the people were vegetarians, we could control climate changes, says english physicist Alan Calverd.

 

And not only that – there would be much less civilization diseases, because it is proved, that meat is the risk factor for many civilization diseases.   

 

According to written, we ask all who are interesed, to support our appeal for instant interruption of execution of bears and therefore to intervene at The Government of The Republic of Slovenia, at The Minister of the Environment and Spatial Planning and at The Slovenian Hunting Association.

Stara Pazova City – 70 Dogs to Die at End of April ?

 Authorities for the region are located at Stara Pazova.

 Kasper animal welfare President is Mr. Petar Djordjevic – saviour for the animals.

 Mr. Djordjevic has, from his own pocket, financed everything that is needed at this shelter and has never received any help from the municipality.  Mr. Djordjevic has stepped in and helped the dogs to survive and keep living where the authorities have failed.

 But now the authorities want to destroy everything that has been done regarding this shelter – INCLUDING THE KILLING OF ALL THE DOGS LIVING THERE – AROUND 70 Animals.

 It is said that the Directory of Veterinary – Mr. Miroslav Marinkovic did not give permission for the shelter; despite everything being ok. 

 The shelter is located at the border of this city, and the Director of Veterinary Department of Ministry of Agriculture –  Mr .Miroslav Marinkovic, and  the Chief of Veterinary Inspections for the Republic of Serbia – Mrs Sanja Celebicanin, another well known problem to us,  suddenly request that the shelter be put somewhere very far away from the city.

There do not ever appear to have been any legal problems in the past with this shelters location.  When Mr. Petar Djordjevic originally built this life saving shelter at the border of Nova Pazova City; no one said anything at the time, it was all ok.

Now, several citizens are not content and they have brought charges to the local Communal inspectors, who have demanded the removal of all 70 dogs from the city pound and their killing after 3 days, simply because they have written that the
dogs are too noisy.  The communal inspectors have made this declaration without actually undertaking any noise survey of the shelter perimeters.  A completely unfounded and arbitrary decision simply to get rid of the shelter and the dogs.

Now these 70 dogs at the shelter are in real danger because after the Eastern holidays the Shinters (Dog catchers / killers) will take all these dogs and attempt to kill them after a maximum further 3 days.  Some of the dogs will probably be killed immediately, as the city pound where they will be taken to is very small and cannot hold an additional 70 dogs.

Shinters on 24-th April, take 8 dogs but Mr. Djordjevic acted and managed to get the dogs back.  But they  said  to him that they will come again after the Easter holiday and that they will take all dogs.  They didn`t say  when  exactly they will do this but the shinters have documentation (ssen by SAV) and they can take the dogs whenever they want.

You have all now demanded that the shelter which is located at the border of this city, be put somewhere very far away from the city.  The location of the shelter was never a problem in the past; why did you not act when it was being built ?

We know already that on 24th April the shinters attempted to take 8 dogs from

the no kill shelter, but their attempts were unsuccessful.

 

Even though you represent local authorities and national veterinary organisations, you do not appear to know, or want to enforce existing Serbian animal welfare legislation.  I will remind you of Article 46 of the Serbian Veterinary Law, which declares:

 

Article 46 of the Serbian Veterinary Law

 

  • that animals have a right to life.  There is NO LAW declaring euthanasia has to be undertaken as a means of stray / street animal control.

 

  • each local community in Serbia has an obligation to provide care for abandoned dogs and cats  – AND THAT INCLUDES Stara Pazova !

 

  • each community has an obligation to finance stray animal care, including the building of shelters

 

  • each community has an obligation to finance sterilisation, medical care and food for the (stray) animals  – AND THAT INCLUDES Stara Pazova !

 

 

Your actions over the coming week are being monitored and every action you take to attempt to remove or destroy the dogs at the Nova Pazova shelter will be reported to every MEP of the European Parliament, as well as EU animal welfare organisations and Parliamentary committees, asking for Serbia to be kept out of the EU until it enforces Article 46.

MEP Asks Questions About the Killing of Cats and Dogs

May 2007.

In May 2007, Mr. Bart Staes, a Belgian Member of the European Parliament (MEP), submitted a written Parliamentery Question (E-2632/2007) to the Commission.

The following is a transcript of the question submitted by Mr. Staes:

I regularly receive e mails drawing my attention to serbia’s use of European money to slaughter dogs and cats in a barbaric manner.  In particular, the city of Nis is accused by animal rights activists of committing such excesses.

Apart from the fact that this is contrary to the humane treatment of animals – ‘sentient beings’ – the use of European funds for such practices is unacceptable.

 

Is the Commission aware of these practices, and is european money in fact being used ?

If so, what steps will the Commission be taking to put an end to such practices ?

Is the Commission attempting to prevail upon the Serbian authorities to put an end to such practices ?

If not, why not ?

 

In July 2007 an answer was given by Mr. Rehn, (Commissioner Rehn) on behalf of the Commission.

It was:

The Commission asked the european Agency for Reconstruction (EAR), to which the implementation of the majority of Community assistance to Serbia is delegated, to look into allegations that this assistance is being used to perpetrate the inhumane treatment of stray animals in Serbia, and in particular the city of Nis.  The Commission has received confirmation that none of the assistance implemented by the EAR has been used for this purpose.

The Commission has no knowledge of whether bilateral member State assistance has been used, as these funds are not part of the European Community budget.

The Commission is aware of the need to ensure animal welfare and notes that this is one of manifold challenges that a country in transition, such as Serbia, will need to address in meeting internationally recognised norms.
