Romania: Latest News About Strays. Animal Welfare NGO’s Are ‘Extremists’; Meetings of the Government Held In Secret – Shambles !!

In June, the Chamber of Deputies decides to send back to the Committee for public administration the PL912/2007 on the management of stray dogs, with the recommendation the animal welfare organizations to be consulted and to give a coherent, efficient, ethic form at the law and then, to return to Parliament.

2 weeks ago during a debate of about four hours, the animal welfare organizations representatives explained to those five members of the Commission present at the meeting, with relevant arguments why the project, why the legislative project is unconstitutional, illegal, ineffective. USELESS!! Because part of them don’t want to understand and others are interested exactly in making a bussiness by maintaining in the street a constant number of dogs.

Yesterday, September 14, the president of the Committee, Sulfina Barbu (PDL), decide to introduce the project for discussion, in secret, outside the agenda, when only a part of the committee members are present and no NGOs nor the media have no possibility of access.

By aberrant speeches of two deputies the animal welfare organizations are called extremist “because they do not accept euthanasia but sterilization”, trying their best to denigrate their work and the animal lovers.

Defying any logic, showing a contempt for citizens, for animal welfare organizations (of which they rejected for the third time all the proposals), the Committee adopted the same form containing a lot of absurd, stupid, discriminatory, unconstitutional provisions, and going beyond the regulation of this law:

– stop any chance that the problem of stray dogs ever to be solved
– the city hall choose the method of dog management (euthanasia, incarceration or return) after consulting the citizens of the locality; consultation is defined as asking everyone, 1000, 100 or only 2, depending the interest of the mayor
– gives the possibility of killing all dogs, including those with owner, in a period of up to 3 days
– any dog ?? with owner can be taken by the catchers;
– obstruct and discourage adoptions; you can adopt a dog only if you show the proof of living space, material resources and pay a fee. In the context of the adoption must be stimulated, the Commission decided to euthanasia all the adoptable dogs on the taxpayer expenses.
– Obstruct / block the possibility of returning the dogs;
– the dog catchers have the right to sanction and control the dog owners

In the 19-20 or 26 to 27 September this disastrous project come to vote in the plenum of Chamber of Deputies.

Romania is known worldwide for incredible acts of animal cruelty.

Healthy animal euthanasia is not agreed at EU level, nor is the method to solve the stray dogs problem. It is unacceptable that Romania, after 10 years in which hundreds of thousands of dogs have been killed, spending tens of millions of Euros from the tax payers, to want to apply the same barbaric and ineffective method.

In the form adopted by the Committee for Public Administration, Territorial Planning and Ecological Balance, the law contains absurd and unconstitutional provisions, stops any chance that the problem of stray dogs ever to be solved, obstruct and discourage adoptions, gives power for control and sanction to the dog catchers, gives the possibility to any dog catcher to take any dog with owner and kill it.

We urge you to reject this project in the form adopted by the Commission for Public Administration and to adopt a coherent, efficient and civilized program: Neuter, Identification& controlled Return as the control of reproduction, combined with education in responsible dog ownership, being the only practical and permanent solution ? according the recommendations of Committee of technical experts from World Health Organization, Geneva.

In May this year were over 200 dogs killed in one night at this municipal enclosure. People protested in Romania and all over Europe and the mayor promised to repent.

Now, the municipal mayor and the shelter manager instead let the dogs starve and die. Abandoned and neglected.

What about, the area of ethic, morality and animal laws?

They are starving for at least two weeks, the guards have confirmed that nobody brought them food. From the photos one can see that even the feces are no where on the ground, not that anybody cleaned. These dogs are just a bag of bones and can barely stand.

They have been brought in from the streets healthy and playful. Now they are dying.

The puppies are placed in a death box, where the Parvo virus is still present, because this virus disappears only after 6 months and is resistant to the common disinfection. Not that is has ever been done any disinfection.

Some die, some are brought in this continuous circuit of death. Once there the little ones die in maximum one week due to the diarrhoea, vomiting and dehidratation.

They are not fed at all, why for, if they will eventually die anyway. Any puppy arrived there, even if adopted later on, extremely weak, not vaccinated, will die despite all the efforts put in place to save them.

They are starving for at least two weeks, the guards have confirmed that nobody brought them food. From the photos one can see that even the feces are no where on the ground, not that anybody cleaned. These dogs are just a bag of bones and can barely stand.

Dear sirs,

I am sending you this protest letter, because I have had enough with the obvious unwillingness of Romanian authorities to solve the problem of strays overpopulation in a civilized, humane manner, as recommended by the European Convention, The World Health Organization as well as major international organizations for animal welfare and protection.

What has surfaced again from the city of BOTOSANI, about the way stray dogs are held in the city’s pound without FOOD and WATER for weeks, about the fact that the pound is LOCKED all the time, people who would like to go and visit and adopt need written approval, the fact that the local animal protection association (ADOR) and volunteers who want to help those poor innocent animals are denied access, the photos of STARVING animals and over crowded kennels, is one more example of the barbaric way Romania treats animals and of the fact that Romanian elected officials and authorities (DVS, POLICE) supposed to implement the laws of the land, show a total disregard towards them and total indifference about the image Romania has in the world now.

People from around the world are outraged by the attitude of the Mayor, Deputy Mayor, Sanitary-Veterinary county officials, Botosani Police with regard to this DEATH CAMP which is the city pound.

Yet, the same officials continue to pay from the public money, salaries to dog catchers, care takers, and probably a veterinarian who can’t wait to find a new reason to “euthanise” hundreds of animals again.

We are determined to protest to the EU Parliament and to ask that sanctions will be imposed on Romania for the way animals are treated, for the fact that international Conventions and recommendations are not followed by Romanian authorities and for the fact that even Romanian laws in force are not applied.

We did not forget the horrible mass killing of 230 dogs in just a couple of hours in May 2011.

Please take all the necessary measure to close this death camp which is the city pound of Botosani, once and for all, and to collaborate with Romanian and International Animal Protection associations who are more than willing to help the stray dogs in your town and county.

Please start a mandatory sterilization campaign in your town and county as soon as possible and show the world that Romanians are still capable of compassion and able to solve the problem of strays overpopulation in a humane and civilized manner as expected from a civilized country, member of the EU in the 21st century.

Please allow access to the city’s pound to anybody willing to visit, every day, like in all civilized countries in the world, and please let those who really love and care for the animals to take care of those poor victims of such a barbaric mentality.

Australia: Live Export Ship With 67,000 Sheep Left Stranded For Over A Week – Gillard Needs To Be Reminded To Stop Aus Exports In Parliament Vote This Week – Mail Her To Show Your Disgust At Aus Live Exports.

After 20,000 people across Australia attended rallies in protest of the live-export trade last Sunday, now is the perfect time to capitalise on this momentum by pressing Australian Prime Minister Julia Gillard to allow MPs a conscience vote on Thursday about whether to ban the hellish journeys endured by sheep (a conscience vote allows members of all parties to vote with their hearts, rather than towing the party line and risking being expelled from their party).

Every year, millions of Australian sheep are crammed onto multilevel, open-decked ships bound for ports in the Middle East and North Africa. When they arrive, they are dragged to shore as if they were sacks of coal, and their throats are cut while they are still conscious.

Please e-mail Prime Minister Julia Gillard and ask her to listen to the compassionate public around the world, which wants the hideously cruel live-export industry stopped.

The RSPCA says it is furious 67,000 sheep have been left stranded on a cargo ship that has broken down off Adelaide for a week.

The Al Messilah left Adelaide last Tuesday, bound for Kuwait in the Middle East with the sheep on board.

Shortly after it left the ship came into engine troubles and had to return to the Port last weekend.

The sheep remain onboard the carrier, while the ship is being repaired.

Chief Executive Officer of Flinders Ports, said feed was being taken out to the sheep while the boat was in the Port.

“Obviously being in the port for an extra week has meant that they would need more feed cargo on board,” he said.

“They’re doing the repairs at the moment and we would hope they’d be done in the next couple of days so they can leave.”

The RSPCA claims the ship involved is one of the oldest vessels in the live export fleet.

“This incident highlights the inherent risks in transporting animals over such vast distances by sea, risks that the industry has never been able to address,” RSPCA CEO Heather Neil said.

“The RSPCA’s immediate concern is for the animals on board and has requested access to ensure the welfare of the sheep is protected.”

“The journey to the Middle East was already going to take up to 20 days and that these sheep have already been in limbo for seven days is completely unacceptable,” she said.

“This is exactly the same number of sheep that were on the Cormo Express,” Ms Neil said, “Whether it’s trade disputes or mechanical breakdowns, animals in this trade are always at risk.”

Greens NSW Senator, Lee Rhiannon said the stranded sheep is a reminder of the perils of live exports.

“The welfare of the thousands of sheep contained on the Al Messilah, a former car transporter built in 1980, has been compromised before they even reach the abattoirs of the Middle East,” Senator Rhiannon said.

“The spotlight is now on this vessel and the welfare of the sheep on board because it struck trouble near an Australian port.”

“If the ship had faced problems way out at sea, would we have ever known?” she said.

Late today, the RSPCA were refused access when they attempted to board the boat.

The Federal Government suspended live trade exports two months ago, after concerns over the welfare of animals exported to Indonesia.

Only six days ago, live exports to Indonesia resumed, with the first shipment of cattle leaving the Port of Darwin.

EU / Serbia: Are They Both Leading Us Up The Environmental Garden Path ?

Stara Planina, Serbia – Update – 02/08/2011.

As a result of our involvement over quite some period relating to flora and fauna protection campaigning at Stara Planina, Serbia; we were informed by the EU that the issue would be raised with the Serbian government at a meeting in Belgrade, Serbia, in April 2011.

The wording that we were provided with on 31/07/2011 is:

Dear Mr. Johnson,

On behalf of Mr. Hxxxxx, I would like to inform you that we have raised the issue of Stara Planina during the meeting with the Serbian authorities in April 2011. However, due to the heavy agenda and the limited time available for the discussions, it was agreed that information will be submitted to the Commission in writing.

We will keep you informed once we have received more information from the Serbian authorities.

We consider this is unacceptable and that with such an important environmental issue, time should have been made available at the April Belgrade meeting to discuss Stara Planina much further.

Not happy with the response, SAV founder Mark Johnson has now responded to the EU, asking that copies of the official Serbian government response about Stara Planina be provided to him by 22/08/2011.  As the EU appears unable to define any deadlines on this specific issue for the Serbian government to respond, we are now attempting to set deadlines with the EU, who in turn need to act urgently and get a response from the Serbian government this month.

Despite what you say and with all the good intentions; I find your response completely unacceptable.

The information which I personally was provided with on 30 March 2011 by Mr. Hxxxxx declared:

“The Commission is aware of the situation of the Stara Planina and we are addressing this issue in the context of the EU enlargement process. In this context and in order to receive updated information from the Serbian government, we are going to raise the question on the situation of the Stara Planina site at the next EU – Serbia Sub-Committee Meeting that will take place early April in Belgrade. I will be able afterwards to come back to you with more information”.

Your mail of 29 July can provide me with no further information other than to say that you have left the issue of Serbian flora and fauna destruction in Serbia with those who are performing Serbian flora and fauna destruction – namely the Serbian government.

If my experience of attempting to deal with the Serbian government over environmental / animal welfare issues during the past 7 years has taught me anything, it is simply that Serbian government officials are xxxxxxxx and will do everything in their power to avoid having to respond to you, me, anyone, about Stara Planina until all the destruction has been done; flora / fauna species have been depleted and certain Serbian officials have money rolling in.

The EU is supposed to be fighting to stop environmental destruction at facilities such  as Stara Planina.  What we see as a result of your last meeting in Belgrade appears to be another ‘back burner job’ with the Serbian authorities setting the agenda and dictating to you when you will be getting a response about the environmental destruction that they are doing at Stara Planina.  I guess that is very much a case of the Serbian government telling you what you wish to hear in order that the EU Accession door is kept wide open for their membership in the near future.  Animals and plant species coming a very poor second.

If anyone, either you (the EU) or the Serbian government, does care about environmental destruction in Serbia at locations such as Stara Planina, then can I suggest that your time limited discussions should have been extended to consider such issues as environmental destruction in Serbia.  Possibly you will learn to allocate more time for your next Serbian meeting so that Serbian environmental issues, which so many exiasting EU citizens have big concerns about, can actually be addressed and sorted out there and then, rather than simply being jotted down on notes, and responsibility for further actions being put back in the hands of  politicians – those running Serbia.

Please look at the photographs I am attaching and take time to ask yourself – is this something which should be left with officials on the back burner of meetings with the EU ? – more continued destruction until the next important EU / Serbia meeting ? – then to be put off once again ? – I suggest not.  Obviously you feel differently.  So what power to the ‘EU man’ on issues such as this ?

Lets say that if I have not had further response from the Serbian government and also yourselves on the issue of Stara Planinna by Monday 22nd August, I will be informing all global supporters to my site that the EU has left the issue of Stara Planina environmental destruction in the hands of those who are responsible for this exact thing; a bent and corrupt Serbian government.

I hope and very much trust that you will inform the Serbian authorities that the issue of environmental destruction (by them) at Stara Planina is still being monitored by EU NGO’s, and that every attempt to expose the environmental destruction at this facility will continue to a global audience.  Can I suggest that you provide me with a written copy of the Serbian government response on Stara Planina by Monday 22nd August, as I have no faith in being led up the written / verbal path that some future meeting of yours in Belgrade sometime in the distant future is going to do anything to halt the killing of species of wild animals and plants in the SP sector of Serbia.

I very much look forward to your / Serbian government response by Monday 22nd August; otherwise it will then be necessary to make public, to EU government and international press, the failings which have taken place at the Belgrade meeting of April 2011.

If there is no response by the Serbian government on the issue of Stara Planina by 22 August in relation to the April Belgrade meeting; then I consider this a failure by all parties concerned. 5 months is long enough for the Serbian authorities to respond;

I very much suggest that they do and that you and Commissioner Potocnik ask them to act; and quickly.

The Serbian Government proclaimed in 1997 Stara Planina as a Nature Park, enjoying the First Category of Protection – as of utmost importance for the country. 

Stara Planina also has the status of a significant International region. It is on the list for International Important Birds, on the list for International Important Plant Areas, on the list of Prime Butterfly Areas in Europe, on the preliminary list of Cross-border Biosphere Reserve under UNESCO protection (Man and Biosphere, UNESCO), on the list of Important Ramsar Sites (peat meadows), on the Emerald list (sites significant for conserving the European ecological network), and also on the list of cross-border protected region placed in the European programme Green Belt (IUCN), on the list of ProGEO geological heritage sites under The European Association for the Conservation of the Geological Heritage.

There are 344 moss species on Mt. Stara Planina. Among them are numerous species which are supposed to be protected by various international and Serbian laws. Species that live on decaying wood and peat meadows are very threatened. One great danger for these species are the hydro-geological works, because of great changes in the water balance of their habitat. Under great threat is Buxbaumia viridis, which is protected within the Bern Convention and Habitat Directive in the whole of Europe, because of habitat destruction (wet tree trunks) which is threatened because of the forest destruction.

With ski-centre construction on the Jabucko ravniste, the peat meadow and water usage from Dojkino vrelo peat meadow, two most important peat meadows will be destroyed. This is a direct threat for all peat meadow associated moss species.

Diversity of flora in the Serbian part of the Stara Planina mountain (the other half is in Bulgaria) with at least 1195 growing plant species, of which 116 (9,7% from all recorded species) are locally or regionally endemic. Endemics are the most threatened category and also the most important floristic elements for the biodiversity. An example of the danger of wild tourism development is seen in the near extinction of Winged Bell (Campanula calycialata) which grew only on Stara planina.  One part of this fragile population was destroyed during the first phases of the project.

On Stara Planina grow 9 species from the World Red List,

42 species are on the  European Red List of which 4 are CRITICALLY endangered, 3 species from the Habitat Directive (Gentiana lutea), 45 species from the CITES list (41 species of orchids), 179 species with the regional IUCN threat status, 14 species from the National Red List and 153 species from that are protected in various ways by the Serbian national legislature. Also, 21 plant species are LOCALLY CRITICALLY endangered (IUCN YUCR)

From the Decree on the Protection of Natural Rarities (Official Gazette of Republic of Serbia: No. 50/93) 40 species are present and therefore IT IS ILLEGAL to damage and destroy their habitat. The Bern Convention also protects 2 species growing on the mountain.  Peat meadows are habitats for dozens of endemic plant species. On the peat meadows of Stara Planina, grow about  50-70 endemic species on average, one of the most important is Sundew (Drosera rotundifolia), a very rare and very threatened insectivorous plant species which became extinct in other parts of Serbia. It should be remembered that mountain peat meadows today represent the most scarce and threatened World ecosystems. According to IUCN categorization, they are specified among fragile (very sensitive) ecosystems, in which the smallest changes of abiotic and biotic factors are CRITICAL (the disappearance of only 1-2 species can result in total COLLAPSE of the system.). 

Construction of ski tracks (which involves both logging and bulldozing activites) on fragile steep slopes will unavoidably begin a process of erosion; this has already happened on some parts of the mountain where development was illegally started.

On Stara Planina live 136 species of butterflies, of which 3 are protected by the Bern Convention, 4 are declared as national rarities by the Decree on the Protection of Natural Rarities by IUCN categorization.

Of the butterflies that live on Stara Planina, THERE ARE 6 ENDANGERED SPECIES.

From the European conservation concern, there are 14 species recorded which are crucially dependent on peat meadow vegetation – and at least three of the species are living on the territory of the planned mega ski resort (Babin zub, Midzor, Topli Do).

Considering fish fauna of the mountain (26 species), the most important is Brown Trout In addition, in the cold mountain rivers lives the Golden Loach (Sabanejewia aurata) which is under protection by the Decree on the Protection of Natural Rarities. Also, the Bern Convention issues protection of six fish species which also live in the streams and rivers of Stara Planina Mt.

With the use of mountain springs as water sources for the demands of proposed tourist accommodation facilities, severe damage to the current water balance is expected, and the resulting effects on aquatic animals will be extremely harmful. Numerous streams and small rivers that are fragile ecosystems will also be threatened by pollution from effluent and drainage.

On Stara Planina live 18 species of amphibians and reptiles, of which 10 are protected under the Bern Convention, while 8 are protected by the Decree on the Protection of Natural Rarities. It is almost certain that many species will be lost if  and when the works proceed.

So far, 206 bird species are recorded on Stara Planina. From that number, 140 bird species are protected by the Bern Convention, but some of them have ALREADY BECOME EXTINCT recently on Mt. Stara Planina due to human activity.

Localities are under consideration for development which will endanger nesting / bird species which have bred there in the recent past and which are currently protected by both the Bern Convention and the Decree on the Protection of Natural Rarities.

It is of great importance for every one of the above flora and fauna species that THEIR HABITAT REMAINS PRESERVED, and is not ruined by government ploitical ignorance of environmental legislation.

There are some 60 species of mammals on Stara Planina, among which some are very rare, including the Snow Vole (Chionomys nivalis), also an extremely rare living fossil of Tertiary origin which lives on the highest slopes of the mountain; it is directly threatened by the ski resort.

Together with Snow Vole, under the Decree on the Protection of Natural Rarities, an additional 19 mammal species and their habitat are protected. Under the direct threat of habitat destruction are the Lynx (Lynx lynx), Marbled Polecat Vormela peregusna, Mole Rat (Spalax leucodon), Suslik (Spermophilus citellus), Water Shrew (Neomys fodiens) and the Southern Water Shrew (Neomys anomalus). The Bern Convention, Apendix II is protecting 6 species: Suslik (S. citellus) Brown Bear (Ursus arctos), Marbled Polecat (Vormela peregusna), Grey Wolf (Canis lupus), Wild Cat (Felis silvestris) and Otter (Lutra lutra), while Apendix III also protects an additional 12 species.

Only the Grey Wolf and Wild Cat in Serbia are not protected by law and sadly enough, considered as game animals by Serbian hunters who have a love for the destruction of nature. Animals detailed above, especially those from Apendix II, are now seriously threatened with habitat destruction from the building and future existence of the ski resort.

According to many scientific findings, this kind of tourism is likely to be unsustainable due to climate change (higher warming temperatures and lower snow yield), strong competition in the region and diversity destruction which will take result.

It is vigorously recommended that an alternative of rural (agro / eco and ethnic) tourism should be developed and made profitable on a sustainable basis without  any major habitat destruction.

This would require less investment and would benefit and preserve the local communities. This kind of tourism would very much improve the quality of life of local people by enabling them to find additional outlets for their food and craft products and local services.

Eco-tourism has been previously recommended by IUCN as the only acceptable kind of tourism development of this region. Also the World Bank is now working on a project with local communities to improve ecological management of Stara Planina Nature Park (142,000 ha), biodiversity and sustainable natural resource-use incorporated in a major agricultural and rural development program, for example including c.30,000 ha of grasslands under sustainable grazing.

Respected Minister;

I find it necessary to write to you after witnessing the terrible photographs of conditions in which animals are being kept at ‘VUK’ Zoological Park, Novi Pazar, Southern Serbia.

This facility has many animal species including wolves, bear, fox, lion and tiger.

Information in my possession which forms part of the ‘Official Document on the Law for Animal Welfare Serbia’ – Section 14; the Protection of Animal welfare in Zoo’s, sanctuaries or breeding facilities of wild animals; makes it perfectly clear that you, as the responsible Minister, have signed and therefore approved the individual zoo licences which are required for such establishments as VUK’ Zoological Park to operate.  Legislation wording states:

“Clause 71 – Conditions about animal welfare that are listed in clause 1 of this document section 14 have to be fulfilled and this has to be formally approved and verified by minister”. In effect, this means that provisions must be made to represent the conditions and requirements of every single species of animal that is in captivity.

Clause 71 also declares:

1)                 Space and equipment for keeping and reproduction of animals in captivity which are adequate for the needs of every particular animal breed – for every animal species.

In the official Serbian law, there is an official requirement for every individual animal species to be provided with facilities for both its individual species space requirements and its (species) equipment; this meaning things such as rocks, trees, foliage and water pools which are adequate for use by every type of (different) animal species which resides (lives) at any Serbian zoo facility.

One only has to look at the photographs of ‘VUK’ Zoological Park, Novi Pazar, to see that there are no compliances whatsoever to adhere with the individual species requirements of the animals which are currently kept there.  This facility does not comply with Serbian animal welfare law; it is simply a hell for all animals which exist there – animals which do not live, they simply exist.

For example, a tiger should be provided with access to a water pool as well as trees to take shade under, logs to climb over and at the very least, soil covered ground.  The tiger should not be simply thrown into a bare concrete floor cage and deprived of facilities such as a pool, which is obviously lacking as can be seen from the photographs.

Wolves should also be provided with facilities for both their space requirements and equipment.  Wolves are roaming animals and this ability should be reflected in their facility. The keeping of two wolves together in a cage measuring approximately 8 metres square is nothing more than the complete and utter abuse of an animal which in nature has a territorial range of many square miles.

Look at photographs of the ‘VUK’ Zoological Park facilities and then inform me that this place is compliant.  It is not; it is a living hell for every animal that exists there.

Clause 71 of existing legislation declares that as (just) part of his official requirements; “The proprietor of a zoological park or a mini park, sanctuary or a nursery/ breeding facility for wild animals has an obligation to provide”:

  • Provision of ongoing health care
  • Food and water in conjunction with needs for every particular animal breed/ species
  • Financial means that are necessary for continuous work of the zoo.

Clause 72 of the official legislation for animal welfare in zoos requires that;

“Persons responsible for the protection of animal welfare in zoological park, sanctuary or breeding facility for wild animals must have completed studies at academic level with title – diploma – master in veterinary science (doctor for veterinary medicine) or biological science (diploma zoologist /biologist – master)  or completed basic studies in the length of minimum of 5 years in the field of veterinary science or minimum of 4 years in the field of biological science”.

Persons that are in direct care of the animals must be trained in the welfare field”.

I would therefore request that you provide me with details of the following in relation to the person responsible for / the zoological park proprietor of the

‘VUK’ Zoological Park, Novi Pazar, Southern Serbia:

  • What academic studies have they completed with regard 5 years of veterinary science, or 4 years of biological science ? – where were these undertaken and please provide me with certified / documented evidence that such qualifications exist
  • What training have all persons associated with the keeping of animals at ‘VUK’ Zoological Park been given ? – please provide me with certified / documented evidence.
  • What provisions are established for ongoing animal health care ?
  • How often are the animals inspected fully by a veterinarian who is certified for their individual species ?
  • Is ample and adequate food to meet the specific needs of every particular animal breed / species provided on a daily basis ?
  • What are the “Financial means that are necessary for continuous work of the zoo” ? – looking at the photographs of the ‘VUK’ Zoological Park it would appear that the place should either be immediately closed down or alternatively be provided with a huge financial investment to support the current missing animal welfare requirements.

I would personally declare to you that from the photographic information I have in my possession, there are no persons involved with the facility at ‘VUK’ Zoological Park, Novi Pazar, who are in any way adequately trained to keep such animals which are currently surviving at this alleged zoo park. 

Part of the ‘Official Document on the Law for Animal Welfare Serbia’ – Section 14; the Protection of Animal welfare in Zoo’s, sanctuaries or breeding facilities of wild animals; makes it clear that you, personally, as the responsible Minister, have signed and therefore APPROVED all of the individual Serbian zoo operating licences

Therefore, as the individual person responsible for the approval and certification of operation of this (VUK’ Zoological Park) facility and all its alleged highly qualified and trained / certified staff, I consider that you will therefore have no trouble in providing me with the documented proof that I have requested.  If you are unable to provide me with the proof that I have requested, then I have no option but to consider that this facility at ‘VUK’ Zoological Park, Novi Pazar, is operating illegally and in non-compliance with existing Serbian legislation for the welfare of animals Section 14. – the Protection of Animal welfare in Zoo’s.

If this is the situation, then I consider that you, as the Minister who should have signed for (licensed) and approved this facility, are personally also being non-compliant with your adherence to existing Serbian animal welfare legislation.

I am hoping that you will act in accordance with Serbian animal welfare law and withdraw some of the licenses that you have signed for zoos that are obviously inadequate to the requirements of individual animal species – because from what can be seen from many photographs that I have, not many zoos in Serbia appear to be providing a completely adequate living environment required by the individual wild animal species that are being kept within them.  You, as the Minister, should be fully compliant with the enforcement of standards detailed Clauses 71-73 for the Animal Welfare Law.  Even more importantly, you should you be enforcing it – something which you appear to fail superbly with at this present time.

It is now my opinion that you sir, as the Minister responsible for zoos throughout Serbia, should immediately undertake a full review of every permit / license which has been issued.  A full review of the living conditions for all species of animals in each and every zoo is necessary, as I consider that you will find that welfare legislation is not complied with in many instances.

I am also making a representation of this information that I have obtained; including a collection of photographs, to the EU Commission; information which will be considered as evidence for the ‘EU Zoo Enquiry’. This is an independent study, which has not been instigated by the European Commission; however, the Commission is fully aware of the investigation and its objectives, and officials have expressed an interest to carefully examine the study’s outcomes.

The aim of The ‘EU Zoo Inquiry 2011’ is to evaluate the implementation and enforcement of the EC Directive 1999/22 (relating to the keeping of wild animals in zoos), its transposition into national law, national enforcement of that law and the status and performance of zoos in compliance with their legal requirements. A report will be produced for each country, along with a further assessment of the effectiveness of the EC Directive 1999/22 and an analysis of captive dolphin facilities throughout the European Community.   Serbian zoo standards are now being added to this enquiry due to the terrible suffering and standards which, for example, can be seen at ‘VUK’ Zoological Park, Novi Pazar.

Serbia wishes to become an EU member state.  The EU has standards for the keeping of animals in zoos.  Both existing member states and those states seeking membership in the future  who are not compliant with existing EU zoo standards will be fully exposed.

What is a ‘Written Declaration’ ?

A written declaration is a text of a maximum of 200 words on a matter falling within the European Union’s sphere of activities.  Written declarations are printed in all the official languages, distributed and entered in a register.
MEPs can use written declarations to launch or relaunch a debate on a subject that comes within the EU’s remit.

A group of up to five MEPs can submit a written declaration by presenting a text to be signed by their colleagues.  If the declaration is signed by a majority of the MEPs, it is forwarded to the President, who announces it in plenary.
At the end of the part-session, the declaration is forwarded to the institutions named in the text, together with the names of the signatories.
It is included in the minutes of the sitting at which it is announced.
Publication in the minutes closes the procedure.

Declarations lapse after three months in the register if they have not been signed by at least half the MEPs.
