Live animal export is an inherently cruel trade, which is why it is opposed by every animal protection organisation throughout the world.

It continues for one reason only: profit. What might happen, if exported animals were deemed ‘unfit’ for human consumption and lost all of their economic value? It happened in Pakistan. The reality will shock you.

Please – Stand up to live export cruelty

Today, every MP in Australia needs to hear one important message: The actions of the world’s largest live exporter, Wellard, have contributed to Australia’s worst live export disaster.

They must be held to account and lose their export licence.

How did it happen? When a shipload of 21,000 sheep was rejected by Bahrain, Wellard had no legitimate contingency plan (despite this being a requirement of their export permit).

They considered two options:

1.      Kill the animals at sea and dump their bodies overboard;

2.      2. Pakistan — a country that didn’t even have government approval to take sheep when the ship left Australia.

To avoid another disaster at sea, the Australian government fast tracked Pakistan’s approval to receive the sheep. But there was a glaring omission in this plan. Wellard failed to ensure that the Pakistan Government were willing to import a shipment that had been rejected by Bahrain over disease concerns.

Whether the animals were healthy or not became irrelevant — the Pakistan Government felt they had been deliberately deceived. Local authorities ordered the animals be culled, and Wellard lost complete control.

Deemed ‘unfit’ for human consumption, and without economic value, these animals were treated like worthless rubbish. Animals were dragged, beaten, their throats were sawn at with blunt knives before they were thrown into mass graves — some still alive hours later.

The Australian government has admitted that it’s beyond their control to prevent another ‘Pakistan’. MOUs with importing countries, to prevent shipments being rejected, have failed. Regulations to prevent cruelty on the scale seen in Indonesia last year, have failed.

What is profitable has never been the defining argument between right and wrong in any civilised society. It is offensive to the majority of caring people that profit continues to be used as justification for a trade that has been responsible for such suffering and cruelty.

If you are Australian – Please urgently call on your federal MP and the Minister (Bob Carr) and Shadow Minister (Julie Bishop) for Foreign Affairs to ensure that Wellard loses their export licence for their role in this disaster.

Importantly, please also remind your MP that you will not vote for a party that supports live exports.

Stop the eviction of Animals Asia’s Vietnam Bear Rescue Centre

I write to express my concern that Animals Asia’s world-class bear sanctuary is to be evicted from Tam Dao National Park by the Ministry of Defence.

To close down the only bear-dedicated rescue centre in Vietnam, would send a signal to the international community that Vietnam is not serious about ending bear bile farming and rehabilitating the bears that have suffered.

The Vietnam Bear Rescue Centre should be the pride of Vietnam, and a sign of the prestige of the Ministry of Agriculture and Rural Development.

Please advise the prime minister to overturn the decision to evict the bear rescue centre and honour your agreement.

Vietnam: Animals Asia’s Bear Sanctuary Faces Eviction in Vietnam – Take Action Now – Sample Letter Below.

We’ve had some shocking news. After working so hard over so many years to build a world-class sanctuary for the bears rescued from Vietnam’s bile farms, we are being asked to leave.

On Friday 5 October, the Ministry of Agriculture and Rural Development (MARD) informed Animals Asia that the Ministry of Defence had issued an order to evict the entire sanctuary operation and its 104 rescued bears. There is no justification for this.

It’s believed the park director, Do Dinh Tien, lobbied the Ministry of Defence to evict Animals Asia, so he can hand the land to Truong Giang Tam Dao Joint Stock Company, of which his daughter is part-owner. The company intends to build commercial property including a tourist park and hotels.

The closure would see 104 bears that have been rescued from the bile industry evicted, 77 local Vietnamese staff made unemployed, and financial losses to Animals Asia of more than US$2 million.

After years of trauma from being locked up in small cages and milked for their bile, our bears are now enjoying dens, enclosures and friends to play with. These bears will be forced to return to cages to be relocated. This will have a major negative impact on their mental and physical well-being. It is likely to take at least two years to establish a new centre with outdoor enclosures.

What we’re doing

We’re fighting this eviction notice every step of the way, appealing directly to the Vietnamese authorities, enlisting help from the international community, the media and other NGOs. But most of all we need your help.

Please write to the Prime Minister of Vietnam, and appeal to him to allow Animals Asia’s Vietnam bear sanctuary, which he previously approved and endorsed, to continue operations, and expand, in line with the government’s original agreement.

Dear Honourable Prime Minister Nguyễn Tấn Dũng,

I would like to plead for the preservation of the Moon Bear Sanctuary established by Animals Asia at the Dao National Park, as per the agreement between your government and Animals Asia in 2005.

Apparently, the Ministry of Defence has declared the area of “national defence significance” and that is given as the official reason. However, the management of the Tam Dao National park seems to have an active interest in developing this land into an “eco tourism park” with hotels, and I am sure you agree that an area considered of “national defence significance” – if that were the case – should not at the same time be turned into an “eco” merry-go-round for affluent holiday makers.

So something, clearly, is amiss here.

If the erection of a holiday village does not collide with national security, then surely the established sanctuary does not either.

And there is really no reason why the two could not exist – and fruitfully so – side by side.

I am sure a compromise could be found, without going through with this eviction of the sanctuary, and the bears, which, after all, would be in direct violation of the Vietnam government’s agreement with Animals Asia, to develop a rescue centre on 12 hectares of the park that would permanently rehabilitate and house 200 endangered bears rescued from the illegal bear bile industry.

The closure of this facility, erected with so many people’s donations and good wishes, would mean abject misery for 104 rescued bears, send 77 Vietnamese staff into unemployment, and deplete Animals Asia’s much-needed funds by some US$2 million.

I beg you urgently therefore to reconsider and make sure your government’s agreement with Animals Asia, and the bears, is honoured.

Serbia: Constitutional Court Declares That Subotica City Is Killing Dogs and Cats Illegally – Setting A Possible Change Across All Cities In Serbia.

Campaigners in Serbia have very recently been informed of some very good news.

The Constitutional Court of the Republic of Serbia – comprising 15 judges, made a verdict that the 3. Community document of Subotica (town in Serbia) regarding the matter of the treatment  stray dogs/cats is illegal; it is unlawful and it must be changed.

This is what The Constitutional Court of Serbia has now demanded.

It is the same in all 170 cities in Serbia; but in every individual case for each and every city, it is necessary that the information be supplied to the Constitutional Court.  If this is undertaken, then changes will have to be made for stray dogs and cats in every city.

What this basically means is, that the Subotica city government,  in the period covering 2003 to the present day, some 9 years had  been undertaking illegal actions.

Slavica, on behalf of EPAR, made a request to the Constitutional Court saying that in Subotica city, the city is acting on unlawful  public documents relating to the treatment  of stray dogs and cats.

As we understand it, the regulations made by the local government  (Subotica city) must be in agreement to the legislations made by the Parliament of Serbia.

The Constitutional Court has declared for the third time that the methods used by the city for the killing of dogs and cats is illegal; and that the methods used for numbers (population) control is illegal, because euthanasia should only be used for animals which have an incurable illness or which are in the final stages of any disease that cannot be cured.

The following shows the letter sent by Slavica to the Constitutional Court regarding the existing policy of animal control in Subotica, followed by the letter from the Constitutional Court (6 pages) declaring the view of the court, that Subotica is acting unlawfully at this current time.

This is excellent news, and now gives every city in Serbia the opportunity to make contact with the Serbian Constitutional Court to present them with the information on how dogs and cats are being treated in (their) city.  Who knows, there may be 170 cities throughout Serbia who are currently killing dogs and cats in an unlawful way; a way not upheld by the laws of Serbia.

Serbia: Search Now On To Find And Prosecute Illegal Serbian and Italian Bird Hunters.

Serbian campaigners are now fighting Serbian and Italian hunters who in the past 3 days have killed around 450 birds as can be seen in the photographs.

These birds are protected by Serbian nature laws; but after the police arrested the hunters, word came from higher up (government ?) that the hunters should be allowed to go free, and take all the birds bodies with them.

The Italian hunters also had in their possession some illegal arms.

On 5/9, the police and inspectors have gone to Bujanovac town, but the Italian hunters have already gone and taken the dead birds with them.  Possibly they have gone to a region either North or South of Bujanovac.

By Serbian law, the hunters must be arrested and punished – as they are killing protected birds.  Campaigners think that because of the corruption within Serbia; the hunters will escape pubishment.

Campaigners sent their first charge to the authorities on 1/9/2012 as the police and inspectors did not act in agreement with the law.  Initially the police did, but they were then informed from higher to stop their actions.

It is thought that the hunters may have gone to Jagodina, a Southern Serbian city, or possibly to Natalinci – a South Serbian village where it is known there is a hunters centre.

Further actions are ongoing but will not be published at the moment for obvious reasons.

Ponovo urgiramo jer policija i dalje nije postupila po prijavi od 02.09.2012. i to , da se odmah pronađu 2 italijanska državljana koji su u našoj zemlji 01.09.2012. počinili krivično delo,  Nezakonit lov i napravili štetu od nekoliko miliona dinara samo u krivolovu 01.09. a lovili su i 2 dana pre.  Njih je  je komandir PS Bujanovac pustio da idu slobodno dalje umesto da ih pritvori i konsultuje tužilaštvo za dalje postupanje. .  Komandir PS Bujanovac nije obezbedio materijalne dokaze i mrtve ptice predao upravniku LU Bujanovac.  Mrtve ptice još nisu pronadjene a ovo na slikama nije sve .  Lovci LU Bujanovac kojima su se smučili Italijani, kažu da su 30.08. i 31.08.  pobili još najmanje 450 ptica, sve strogo zaštićene vrste. TO MORA DA SE PRONAĐE; mrtve ptice su još uvek u Srbiji, negde u Bujanovcu  ili u Leskovcu kod Strahinje Nikolića, ul. Blagoja Nikolića 78 , 16000  Leskovac  , koji ih je doveo u lov.  Strahinji Nikoliću je vraćena nelegalna puška petometka br. 561897  kojom je krivično delo počinjeno, a i džip je otišao iako je i on korišćen za izvršenje krivičnog dela i prevoz Italijana i pobijenih ptica. Molimo da se sve to oduzme do okončanja postupka jer će ove mrtve ptice neko morati da plati budžetu Republike Srbije.

01.09. došla su još 4 Italijana u Bujanovac ali nisu smeli više da ih izvedu u lov , pa su ih sve  zajedno,  u organizaciji Strahinje Nikolica iz Leskovca , 6 Italijana odveli da love na drugom mestu. Dakle, napustili su teritoriju nadležnosti PS Bujanovac gde su počinili krivično delo,  ubijali strogo zaštićene vrste ptica  i otišli u centralnu Srbiju i love i dalje. I dalje čine krivično delo  i ubijaju strogo zaštićene vrste ptica.
Saznali smo da se nalaze na podučju nadležnosti PU Smederevo , PS Smederevska Palanka, u selu koje se zove Natalinci gde gazduje LU Natalinci,  gde ima kupljena kuća za boravak stranih državljana koji se bave isključivo krivolovom i ubijaju strogo zaštićene vrste ptica.  U lov ih vodi meštanin sela Natalinci koji se zove Dragan “poštar”, ne znamo da li je stvarno poštar ili mu je to nadimak. Sasvim sigurno ima veze sa LU Natalinci.
Selo Natalinci se nalazi između Kragujevca i Topole.
Molimo Vas da odmah obavestite kolege PU Smederevo,  PS Smederevska Palanka  a od kolega iz PS Bujanovac pribavite imena svih 6 italijanskh državljana jer su ih oni legitimisali i zapisali imena i brojeve pasoša,  i obavestite PU Smederevo da proveri da li su tamo , jer imamo saznanja da se nalaze tamo i love i dalje. Posebno se ne sme dozvoliti da 2 italijana koja su napravila višemilionsku štetu ne napuste Srbiju a da ne plate štetu.
Činjenica je i to da su i naši državljani krivi kao saučesnici u izvršenju krivičnog dela jer su im to omogućili..Neshvatljiva je snishodljivost naše policije prema strancima koji su izvršioci krivičnog dela i neshvatljivo je da su pušteni da idu dalje kao da ništa nije bilo. Pitamo se šta bi bilo sa našim državljaninom koji bi u Italiji napravio ovakav masakr ptica u krivolovu????
Molimo da pogledate fotografije u prilogu, sve ove ptice nisu lovne, vrednosti ovih vrsta su od 10.000,00 do 60.000,00dinara,  po jedinki,  na osnovu Priloga I  I Priloga II ,  Pravilnika o odštetnom cenovniku za utvrđivanje visine naknade štete prouzrokovane nedozvoljenom radnjom u odnosu na strogo zaštićene i zaštićene divlje vrste(“Službeni glasnik RS”, broj 37/10).
Molimo Vas da postupate hitno jer se Italijani opet mogu premestiti negde, mi ne možemo da ih jurimo po celoj Srbiji da bismo sprečili dalje ubijanje ptica ako nas policija stalno sabotira i pušta izvršioce.  Takodje da se postupi po svim tačkama prijave jer u nepostupanju PS Bujanovac stekli su se elementi krivičnog dela o čemu smo podneli pritužbu SUK MUP-a RS.

Predmet  HITNA Prijava I Zahtev da se obezbede I sačuvaju materijalni dokazi izvršenog krivičnog dela koje se desilo na području nadležnosti PS Bujanovac, 2 Italijanska državljana su u krivolovu napravila masakr strogo zaštićenih vrsta ptica, a materijalni dokazi – pobijene strogo zaštićene vrste ptica mogu nestati zbog nepostupanja načelnika PS Bujanovac I PU Vranje I  postoji opasnost da materijalni dokazi izvršenog  krivičnog dela nestanu.

Poštovani,

Obaveštavamo vas zbog daljeg postupanja policije, da smo dana 31.08.2012. god. dobili dojavu da se na terenu nadležnosti PS Bujanovac , nalaze 2 Italijanska državljana od 30.08.2012. I da  bez prisustva lovočuvara idu u lov I  ubijaju strogo zaštićene vrste ptica, drozdove, iz  familije Turdidae.   Sve vrste iz te familije su stogo zaštićene vrste ptica I nalaze se u  Prilogu  I Pravilnika  o proglašenju i zaštiti strogo zaštićenih i zaštićenih divljih vrsta biljaka , životinja I gljiva (“Službeni glasnik RS, br. 5/10”), te je svako ubijanje  tih ptica krivolov na osnovu Člana 276. KZ RS.

Na osnovu Člana 269.st.2.  za sve radnje na ubijanju I mučenju posebno zaštićenih vrsta  životinja propisana je kazna zatvora do 3 godine I novčana kazna, posebno kad se radi o velikom broju ubijenih životinja, što su nesporno 2 Italijanska državljana učinila, kršeći propise naše zemlje ali uz pomoć naših držvljana jer oni sami ne bi mogli doći I krivoloviti I smatramo da je veća odgovornost naših državljana koji ne poštuju propise I protivpravno pribavljaju materijalnu korist. .

Na osnovu Priloga I,  Pravilnika o odštetnom cenovniku za utvrđivanje visine naknade štete prouzrokovane nedozvoljenom radnjom u odnosu na strogo zaštićene i zaštićene divlje vrste(“Službeni glasnik RS”, broj 37/10), propisana je visina naknade  štete koja se mora naplatiti od počinioca koji je ubio strogo zaštićenu jedinku bilo koje vrste, pa je za drozdove u zavisnosti od vrste propisano od 10.000 do 15.000 dinara. Sumnjamo da su pobijeni drozdovi borovnjaci I za njih je odšeta 12.000,oo din po jedinki.

Vrste ptica pevačica ne možemo sa sigurnošću reći o kojim vrstama se radi dok ne dobijemo fotografije , pa će se na osnovu toga znati kolika sve to košta I to neko treba da plati.

Familija Passeridae, gde spadaju vrapci  kojih je ubijeno 6 kom, za 1 jedinku odšteta je 15.000,00 dinara

Red CORACIIFORMES, gde spada Pupavac (Upupa epops), koji je vrlo  retka ptica, odšeta je 50.000.00 din. po jedinki.

Familija Columbidae, gde spadaju grlice, odšeta je 50.000,00 dinara po jedinki,  koja  je ubijena u krivolovu , inače je lovna vrsta.

Pravilnik o odštetnom cenovniku za utvrđivanje visine naknade štete prouzrokovane nedozvoljenom radnjom u odnosu na strogo zaštićene i zaštićene divlje vrste(“Službeni glasnik RS”, broj 37/10),  u prilogu.

Determinaciju pobijenih ptica trebalo je  da izvrši ovlašćeno lice, ornitolog  Zavoda za zaštitu prirode, iz Niša, ali ga niko nije pozvao kao ni nadležnu inspekcijsku službu životne sredine iz Vranja.  Inspektorka životne sredine iz Vranja  je obaveštena o dogadjaju 01.09.2012. kada se videlo da načelnik PS Bujanovac i PU Vranje imaju nameru zataškati dogadjaj.

01.09.2012. u noćnim satima dobili smo dojavu da će Italijani i treći dan izaći da love, nakon čega je naš saradnik iz Vranja,  Djoka Marinković krenuo za Bujanovac u nameri da ode u policiju i prijavi sve a i pomogne policiji u otkrivanju krivičnog dela, nezakonit lov,  jer kao bivši lovočuvar ima veliko iskustvo u radu sa krivolovcima.  Javljeno je da će Italijani ponovo loviti na Bujanovačkom polju što se pokazalo kao tačno.  Kad su krenuli iz lovišta sačekala ih je patrola i zaustavila radi kontrole oko 11.00h .

Dana 01.09.2012. god. tokom policijske kontrole identiteta lica i vozila konstatovano je da se voze u džipu >Nissan domaće  reg.tablice  LE. 037.AP , čiji je vlasnik izvesni Strahinja Nikola iz Leskovca koji ih je doveo da love u Srbiji.  Kostatovano je da imaju dozvolu za lov prepelica  br.1666, izdatu od strane LU Bujanovac .  U  džipu je pronadjeno

1.      zabranjeno oružje za lov, puška petometka nemačke proizvodnje, automatska , br. 561897 koja nije njihova. Vlasnik puške je Strahinja Nikola iz Leskovca i nisu imali oružni list a ni bilo kakvu potvrdu za korišćenje te puške , niti je ta puška dozvoljena za lov. Pušku je načelnik PS Bujanovac vratio  Strahinji iz Leskovca.

2.      2 velike kartonske kutije , pune municije,  kalibra 12,

3.      2 zabranjene  vabilice za prepelice, na baterije I

4.      pronadjena je velika količina pobijenih ptica u džaku, (drozdovi 75kom. , vrpci  6 kom,  5 raznih ptica pevačica, 1 mala ptica pevačica uništena metkom do neprepoznatljvosti vrste, 1 pupavac I 1 grlica)   sve strogo  zaštićene vrste, osim grlice ,  koje se ne love I pripadaju Prilogu  I Pravilnika  o proglašenju i zaštiti strogo zaštićenih i zaštićenih divljih vrsta biljaka , životinja I gljiva (“Službeni glasnik RS, br. 5/10”)

Ovaj džip zaustavljen je po prijavi, radi kontrole,  jer smo imali dojavu da se ta 2 Italijana,  treći dan zaredom bave  krivolovom i ubijaju strogo zaštićene vrste ptica  u lovištu >Golub< Bujanovac, što je krivično delo na osnovu Člana 269. i 276. Krivičnog zakona RS.  To im je omogućio predsednik LU >Golub< Bujanovac i izvesni Strahinja Nikola iz Leskovca koji navodno ima agenciju za lov i dovodi lovce iz Italije , sumnjamo da je sedište te agencije u Paraćinu, >EUROPA TOURS< D.O.O, ul. Nikole Pašića bb.  Sve to divljanje po našoj prirodi , strani lovci  plaćaju im na ruke,  po 50 EVRA po lovcu za lovni dan , ma šta ubili, što predsednik LU I Strahinja podele posle , a o prisustvu stranih lovaca najčešće ne ostaje nijedan pisani trag da su tu bili i lovili jer posle krijumčerenjem,  preko >veze< na granici  iznesu pobijene ptice ili drugu divljač  iz zemlje .

Ističemo i pohvaljujemo veoma korektan i savestan rad policajaca PS Bujanovac ,  Aleksandra Nikolića i Kemala Ramadanija koji su sve to hteli da oteraju u policijsku stanicu na dalju proceduru. Ali, tada su krenuli telefonski pozivi i urgencije da se sve to zataška i to preko načelnika PS Bujanovac ili Načelnika PU Vranje,  koji su  se >konsultovali< i naredili policajcima da ih puste pod izgovorom da >to nije njihova nadležnost

Načelnik PS Bujanovac nije dozvolio da na teren izađe krim. tehničar radi fotografisanja dokaznog materijala na licu mesta, čime je izvršio prikrivanje dokaza krivičnog dela. Medjutim, naš saradnik Mariković je sve fotografisao.

Pored toga, naređeno je da se puška petometka vrati vlasniku a sve pobijene ptice date su upravniku  lovišta Bujanovac ,koji se zove Dragan, nadimak >Mačor< da odnese u lovačko udruženje  gde ima zamrzivač. Verujemo da se u tom  zamrzivaču nalaze i pobijene ptice od prethodna 2 dana lova ili u privatnoj kući u mestu Rakovac gde Italijani borave.

S toga je potrebno hitno izdati nalog za pretres navedenih objekata u cilju pronalaženja ostalih pobijenih ptica i obezbediti da pobijene ptice koje su odnete sa lica mesta ne nestanu.  Ukoliko nestanu, biće da su načelnici policije postupili samovoljno ,  mimo Zakona o policiji i  pomogli da se izvršeno krivično delo prikrije.

Postupkom  predavanja ptica upravniku lovišta koji nema nadležnost za strogo zaštićene vrste ,  obezbedili su da materijalni dokazi krivičnog dela nestanu  i time opstruirali rad i izvrgli ruglu i podsmehu rad patrole na terenu, koji je bio u skladu sa zakonom.

Zbog poniženja koje su doživeli policajci Nikolić i Ramadani , od svojih pretpostavljenih, a radili su savesno i korektno, zbog podsmeha okoline kojim su izloženi i poslate poruke narodu , da se krivično delo isplati,  Predlažemo da se posebno nagrade policajci a njihovi pretpostavljeni kazne u skladu sa Zakonom o policiji!!!!

Imamo saznanja da je nedavno bujanovačka policija pohvatala u noćnom  krivolovu na zeca, sa zabranjenim farovima, neke naše državljane i da je tada znala kako treba da postupa u skladu sa Članom  276. KZ RS ,  oduzela je sve što je korišćeno za krivolov i ulov,a džip koji je korišćen za krivolov se i sada nalazi na parkingu ispred PS Bujanovac, pa je nejasno kako sada za Italijane načelnik nije znao kako treba da radi, nije oduzeo vozilo, oružje ni ulov, nije pozvao nadležnu inspkeciju, nije obavestio ovlašćeno lice za determinaciju ptica već je dao da se sve pobijene ptice odnesu i već danas to sve može da nestane jer ova 2 Italijana koja su sve ovo pobila, danas treba da idu a  nakon toga su nedostupni našim vlastima.

Da stvar bude još gora , juče 01.09. došla su jos 4 Italijana preko Strahinje koji imaju nameru da love i ubijaju naše ptice koje je zadesila elementarna nepogoda, izgorela su im staništa u požarima kojih ima puno na jugu Srbije , izgubili su hranidbene resurse i lov je po Zakonu o divljači i lovstvu morao biti zabranjen, ali se na to niko nije osvrnuo, ni  korisnici lovišta a ni nadležne lovne inspekcijske službe.

Na ovaj način je kasa države Srbije oštećena za najmanje  1.500.000,00 dinara koliko vrede samo pobijene ptice 01.09.2012. koje su bile predmet kontrole.

Isti Italijanski državljani su nam prošle jeseni izmakli sa 450 pobijenih drozdova i ilegalno ih preneli preko granice jer smo kasno dobili dojavu!!! Što govori da je to stalna i česta pojava da nema  naplate štete koja je mogla . puniti budžet  i ko ima pravo da zbog svojih ličnih interesa ovako oštećuje državu Srbiju??? Molimo da to istražite!!!

Molimo vas da postupate hitno po svakoj tački prijave, posebno da se obezbedi da materijalni dokazi, da pobijene ptice ne nestanu, da se oduzme nelegalna puška petometka i vozilo koje je koriščeno za krivolov, džip marke >NiSSAN< domaće  reg.tablice  LE. 037.AP

Afera >Balkanske ptice< traje i dalje a ovo je sumnjamo način na koji se to krivično delo i dalje odvija u Srbiji i pustoši fauna ptica, jer prvi ljudi policije ne poštuju zakon  a veza na granici pušta da se iznesu pobijene ptice na kojima Italijani zarađuju enormne sume novca, a naše domaće neznalice zbog sitnih, ličnih, kratkoročnih  interesa  uništavaju prirodno bogatsvo naše države.

The BUAV, the leading organisation campaigning to end animal experiments, has today welcomed the decision by the UK Government to introduce a legislative ban on the use of stray animals, such as cats and dogs, in experiments. The news comes as draft regulations were published today by the Home Office, to transfer EU regulations into UK law.

After a public consultation last year, it appeared that a current policy ban on using stray animals would be withdrawn. The BUAV launched a vigorous campaign to maintain the ban which was widely supported by the public and MPs. The draft regulations now state that project licences must include “a condition to the effect that a stray animal of a domestic species must not be subjected to a regulated procedure as part of the specified programme of work”.

The new regulations, which will update the Animals (Scientific Procedures) Act 1986, have been published in draft prior to limited Parliamentary scrutiny in the autumn. While the prohibition on the use of strays and Great Apes is to be welcomed, many important issues have been omitted from the draft regulations. For example:

Despite the Directive opening the possibility for a less strict inspecting regime than the UK currently has, the Government has pledged to maintain a ‘strong and properly resourced inspectorate’. It is difficult to see how this can be achieved, however, when the number of inspectors continues to fall.

There is no sign of progress on the issue of transparency, despite the public consultation resulting in overwhelming support for reform of Section 24 of the Animals (Scientific Procedures) Act 1986. The Government has already admitted that Section 24 is incompatible with the new Directive, but has continued to stall by announcing a further consultation on the subject. This further delay means that animals will continue to endure suffering while the public continues to be kept in the dark about what goes on in laboratories.

The Government has also failed to rule out some of the most severe experiments permitted by the Directive, opening the way for inescapable electric shock to be used to induce learned helplessness; animals bred deliberately with genetic disorders which will result in persistent suffering; dogs and non-human primates left in total isolation for long periods of time.

There will be no opportunity for the majority of MPs to debate the new rules, after it was decided that they will instead be examined by a committee, before going to the House of Lords, when Parliament resumes in the autumn. The European Commission requires that they come into force by January 1 next year.

The BUAV Chief Executive Michelle Thew said,We welcome the Government’s decision to introduce a legislative ban on the use of stray animals in experiments. This was an issue raised by the BUAV and one which received strong public and political concern. Elsewhere in the regulations, although pleased that the Government has maintained stricter UK standards in some areas, we are disappointed these regulations come only a week after figures showed the number of animals being used in experiments reaching an all-time high since the 1986 Act was introduced. These are issues which the public care deeply about, and all MPs should have the chance to give their views in a debate in the House of Commons.”

Actor and comedian Ricky Gervaishas joined the BUAV in calling for an end to kitten experiments at Cardiff University. The controversial experiments, uncovered by the BUAV’s research team, have hit the headlines in the UK this week. Thanks to our efforts, millions of people across the country are now aware of these cruel experiments that were publicly funded through the Medical Research Council.

In the experiment, litters of new-born kittens were raised in total darkness for 12 weeks, whilst others were deprived of sight in one eye by having their eyelids sewn shut. Under anaesthesia, artificially ventilated and injected with a drug to paralyse eye movements, the kittens were subjected to highly invasive head surgery and the brain was exposed for recordings. Following the tests the animals were killed and their brains dissected.

This week, the BUAV has received widespread coverage for our message – that these experiments on defenceless kittens are not only ethically unacceptable, but there are alternative ways of studying vision and the neurological processes underlying it in human beings that do not involve animal suffering.

The BUAV has taken part in TV and radio interviews including BBC Breakfast, and has featured in numerous newspapers, including the Daily Mail, Daily Mirror, Daily Express, Daily Telegraph and Wales on Sunday.

Ricky told the BUAV:

I am appalled that kittens are being deprived of sight in one eye by having their eyelids sewn shut. I thought sickening experiments like these were a thing of the past. I support the BUAV in calling for this research to be stopped.”

Again Phil has provided us with a formal CIWF statement which has today (10/07/12) been provided to Serbian campaigners to use and forward on to Serbian government Ministry officials – the very people who should be ensuring that situations like these seen at this farm never happen.

Below is a full transcript of the statement made by Phil Brooke after reviewing the recent photographs and information provided by SAV and Serbian welfare campaigners.

As Serbia is looking towards EU membership in the near future, we would like to draw attention to one particular part of the statement made by Phil; this being:

If a nation is looking at future EU membership, then it must do a lot better than to allow animals to be kept in non-EU standards.  There is no further statement to be made – Serbia needs to improve big time !

We know that conditions on this Serbian farm are not a ‘one off’ – similar conditions are regular all over the country.  We are now working with serbian campaigners to identify and expose these other facilities.

Unsanitary Conditions for Serbian dairy cattle at Rusko selo 1st July 2012

In 2010 we issued a statement relating to the environmental conditions for dairy cattle in this farm. We stated that is was clear from the photographs that these cattle were being kept in squalid, filthy, unhealthy and completely unacceptable conditions. The cattle in the pictures shown were standing in water contaminated with excrement. The matted nature of their coats shows that they were unable to keep clean and had clearly been in these conditions for some time.

We are disturbed to discover that in 2012, conditions do not seem to have improved. Pictures from the farm show the cattle lying in their own manure. Unsurprisingly, their coats were dirty due to being forced to lie in their own excrement. Contact between their udders and faeces and urine and dirt on the teats increases the risk of infection by a range of micro-organisms including e coli. These can cause mastitis which is a risk to the health and welfare of the cattle as well as to the health of people who consume dairy products from this farm.  These are also conditions in which flies are likely to breed with further risks of disease spread.

In the event of rain it seems clear that the lying area would again become waterlogged. Wet feet can lead to a range of hoof conditions and increased risk of lameness.

Cattle need a comfortable, clean and well-drained area to lie down, receive adequate rest and remain healthy. The squalid conditions these cattle are being kept in plainly fail to meet basic welfare or hygiene standards as laid down by Council of Europe Convention and EU Directive which require that animals are prevented avoidable suffering and kept in conditions which avoid risks to their health.

It is clear beyond doubt that what is shown in these photographs does not comply with existing EU legislation, and consequently could impact Serbian accession to the EU. In the event of Serbia’s accession, these photographs could form the basis of a formal complaint to be made to the Legal Affairs Dept of the EU associated with animal welfare.

Compassion in World Farming

COUNCIL DIRECTIVE 98/58/EC of 20 July 1998 concerning the protection of animals kept for farming purposes

Article 3

Member States shall make provision to ensure that the owners or keepers take all reasonable steps to ensure the welfare of animals under their care and to ensure that those animals are not caused any unnecessary pain, suffering or injury.

From the Annex:

Animals not kept in buildings

12. Animals not kept in buildings shall where necessary and possible be given protection from adverse weather conditions, predators and risks to their health.

Council of Europe Convention covering the Protection of Animals Kept for Farming Purposes state, amongst other things:

Article 9

1. Animals should be maintained in a clean condition.

2. Those parts of the accommodation with which the animals come into contact should be thoroughly cleansed, and where appropriate, disinfected, everytime the accommodation has been emptied and before new animals are brought in. While the accommodation is occupied by the animals, the interior surfaces and all equipment therein shall be kept satisfactorily clean.
