REQUEST FOR HELP AND SUPPORT OF OUR INITIATIVE FOR FIRST VEGGIE Festival in Republic of Macedonia

Dear All,

We are Association for animal right protection “ANIMA MUNDI” from Republic of Macedonia (http://anima-mundi.org.mk/), young, non-profit association with numerous members which passionately stands for protection of animal rights – sensitization  of the population regarding the difficult life they are exposed to,  termination of all forms of exploitation and abuse to which they are exposed to by the population. We act relentlessly, continuously for three and a half years with limited funds and resources completely voluntary.

We address You with request for help, with in your capabilities and wish, to support our initiative for FIRST VEGGIE Festival in Republic of Macedonia. In addition we will try to explain why this assistance is so required – for what we believe that we will have your understanding and support.

Although our resources are very modest, limited, we have great enthusiasm and intentions for organizing  an event during the World Days of farm animals, World Day of vegetarianism and  World Day veganism with a strong educative message and campaign for the promotion of human choice, respect and compassion for animals, stimulate human style of life, a philosophy of non-violence and vegetarian or vegan diet.

So far, with our modest resources and founds, on this topic we have organized symbolic information stands, Vegan party, open debates/discussions on animal rights that included info materials, stands and Vegan demonstration.

Realizing that it is necessary to act beyond, we start planning FIRST VEGGIE FEST in R.Macedonia, a festival with a broad and comprehensive program and with maximum visibility. This is a big step for us in our country where the animals are treated at the level of object that exists for the service of man, where are exposed to trauma, pain, extreme cruelty, to try to reach the general public and to be able to change something in favor of the good being of  animals.

The entire engagement of the members of ANIMA MUNDI is completely voluntary – namely dozen people with all their skill and capabilities  try to realize a rich program that will make people think, arise compassion towards animals, will challenge them to no longer be passive consumers and try to change their habits and lifestyle.

HOW WE ORGANISE THE EVENT?

We are trying to :

Print flyers, pamphlets, info materials of the reasons for vegetarianism, veganism (ethical, medical, environmental …) and if possible mobile ads on the bus to convey a message to a wider target group.

–   Organize a two-day informational stands in the center of the capital, Skopje.

–   Organize outdoor video screenings of documentary films  in order to be wached by a wider audience.

–   Organize music events with several bands – as to attract the target population.

– Degustation of  vegan and vegetarian food – to fight against the prejudices that Vege food is monotonous, poor, tasteless and unhealthy (There is a medical myth in Macedonia that meat is absolutely essential in normal diet of human population!)

–   Workshops with children – to stimulate compassion, love, concern for farm animals;

–   Organized lectures by nutritionists – Vegans / raw food promoters / vegetarians

–   If possible to some advertising space (at least one poster and one billboard) in the city center

Everything that can be done by us, we will do with love and devotion and we do not need finance. It includes organization and coordination of two day event, organization of small performance, concept of info materials, design of flyer, educational workshop with children, video screening of educational material…

FOR WHAT WE NEED HELP?

Certain activities depend of money that we do not have but we have to provide  (on your request we can provide you financial statement for bank account of Anima Mundi).  For this  we need your help as support for the part that we can not provide ourselves:

Founds for printing materials   (approximately 200 euro ) ;

Founds for rent of location for Vege fest ( 6 00 euro) ;

Founds for providing/renting sound equipment for the musical event ( at minimum 500 euro ) , as well as symbolic amount to be paid for the participating bands  ;

Founds for food for the event. The food will be cooked by us but we can not provide larger amount, so we need financial help (approximately 200 euro) .

For all of the above and in frames of your capabilities we ask you to support us, our idea and our effort to implement something that will help improve the animal rights and well being in our country .

Macedonia: Vicious and Very Psychopathic Butcher (Literally) Murders Stray Dog Being Cared for by Local People.

Yesterday, in broad daylight at about 10 am, an employee at the Butcher’s Shop Mega in Skopje, Macedonia, murdered a stray dog with repeated severe stabs with a butcher’s knife attached to a metal rod in front of a number of passers by.

The poor animal, covered in blood and in complete agony and shock, was dying for fifteen minutes before the eyes of the passers by, some of them children. This amiable dog which many of the local residents regularly looked after, without attacking, without even barking once at its killer, was literally butchered, stabbed through its body and severely hit against a wall by the professional butcher.

Three of the witnesses reported the case to the police which came to the spot to investigate and compiled a report. In the meantime, the butcher confessed to committing the act, explaining that the previous day that same dog had attacked his wife and child.

The witnesses contacted the local clinic and received information that no person had required medical attention for having been bitten by a stray dog.

This was a premeditated, planned murder, committed in an extremely vicious and psychopathic, devious manner unimaginable to any sane person. The act was brutal, the sight horrific. The photographs of the dead animal alone are poignant, but imagine the sight witnessed by the people who happened to be there, who saw the dog being ripped open, who heard its cries. All witnesses we have contacted are in a state of severe shock and cannot come to themselves. Some of them had been threatened to keep silent, but had nevertheless decided to talk about what they had seen and testify.

We ask for the most severe condemnation for this person, who is a threat and a potential danger to the environment, as no sane and normal person could repeatedly stab a helpless and homeless dog, listen to such cries of agony and continue butchering it in such a beastly manner. The psychiatrics has no doubts that such occurrences are horrifying, that such people pose a danger and a direct threat to their environment and should not be disregarded-it is a well known fact that serial killers start off by killing animals. We ask for a collective condemnation and the most severe punishment for the perpetrator!

Killing animals is a regular occurrence in our country, but punishments and sanctions are non existent. Animals in Macedonia are victims of brutes, both on institutional and individual level. The way a society threats its animals reflects that society, its level of civilization, humanity and awareness. Macedonia is shamefully inactive in that field, despite the numerous reactions from associations and citizens to the authorities. We insist on stricter animal protection laws and implementation of Animal Police, as the terror over animals in Macedonia is never ending daily occurrence.

Macedonia: March for the Pound Vardariste Dogs Organised by “Anima Mundi” – Please Give Your Support by Taking Action – Contact Details Below

We, animal protection association from Macedonia, “Anima Mundi” address You again as the horror in Skopje continues and the mass catching and killing of stray dogs is relentless as ever in the only shelter which exists in Macedonia (the Pound Vardariste),

which has undertaken to operate under a program which prescribes a CNR strategy.
We enclose photographs and video materials of the protest we organized last munth against the killing of stray dogs “Walk for Life” (route: Assembly of the City of Skopje-Government of RM-Parliament of RM). Although the protest was supported by all Macedonian association for protection of animals, as well as the citizens and the media, all of which together EXPRESSED THEIR DISSATISFACTION WITH THE INHUMANITY, THE BRUTAL APPROACH TO DEALING WITH THE PROBLEM I.E. THE MASS KILLING, THERE HAVE BEEN NO IMPROVEMENTS.
 
WE ENCLOSE PHOTOGRAPHS OF THE MARCH, AS WELL AS NEWSPAPER ARTICLES, WHICH WILL GIVE YOU A BETTER INSIGHT IN THE SITUATION WE REACT AGAINST (we also have information that alive or semi-conscious dogs are discarded in waste pits).

1. Although all Macedonian associations have been continually reacting (the official rate of killing is over 60% -unofficially much higher, as huge numbers of caught dogs disappear) nothing has been done so far;

2. There is no record kept of killed dogs and, more importantly, we do not know what they are killed with-the City and the competent institutions hide information and have never responded to our request to present the documents for supply of substances for humane euthanasia (a request they are obliged to respond to by law);

3. There is practically no disinfection-
We need Your help and more stern reactions to

AS OUR COUNTRY ASPIRES FOR MEMBERSHIP IN EU, OUR GOVERNMENT WOULD BE WILLING TO PUT A STOP TO THIS ONLY UNDER STRONG AND PUBLIC REACTIONS FROM INTERNATIONAL INSTITUTIONS AND THE EUROPEAN COMMISSION, AS WE ARE IN REALITY POWERLESS AND THEY ARE ONLY TRYING TO SHUT US UP.

2. Other wery importent thing. We point out that we have support from most of the media, as the situation is obvious, as well as from other Mayors willing to allow implementation of the humane strategy CNR in their municipalities, but financially unable to do so. Please inform us whether any assistance can be offered to us regarding the matter i.e. how can we establish a cooperation with You as supporters of the CNR strategy, what are the preconditions which we need to observe in order to receive Your assistance (in terms of expertise, medical assistance for spaying/neutering, finances, etc.), so we can eventually start with the implementation of a humane solution to the problem.

What a terrible pity that the Skopje mayor does not understand the damage he alone is causing to his nation and their ability to become members of the EU.  The following photograph is that of the mayor:

If you are an EU citizen; please go one step further and provide the details to your MEP, asking that the EU take very serious account of the abuse and suffering inflicted on animals in macedonia as a direct result of the wishes of the Mayor of Skopje.  His actions alone are not acceptable and until he changes his attitude and ways to the welfare of animals in macedonia, you will continue to fight to keep such animal abusers as the mayor out of EU membership.

a target of dog catchers are puppies which cannot be subject to the CRN program (under which the Pound Vardariste officially operates) and almost all puppies are killed or die of distemper and parvovirosis, without any attempt being made for their treatment;

4. The dog catchers are people with criminal history, barbarian and ruthless in their behavior, incompetent to appropriately catch and take care of the animals under any circumstances, which is supported by the reactions of many citizens who have witnessed their operation and many of whom have initiated private charges against the dog catchers; 

 5. Volunteers are still not allowed in the Pound, despite the continuous offer of support on our part;

6.  The Pound is open to the public only 6 hours a week, taking photographs of the dogs kept inside is strictly prohibited, and the overall situation is getting worse with each day;

7. The Mayor approved new employments of dog catchers, despite our strong opposition, and extended the Pound for 200% (while the number of veterinarians remained the same!)-it is evident that the intention is to speed up the elimination process, rather them to implement the CNR strategy. We are convinced that there are currently no conditions for human treatment, which is surely not even intended, supported by the fact that they refuse any cooperation with the NGO sector for protection of animals despite our open offer of assistance!!

EU: SAV Presents Concerns Regarding Existing EU and EU Accession State(s) Stray Animal Welfare Issues. We Need A Voice Across Europe For Stray Animals !

   

 

SAV has today (23/06/10) submitted a written response to ‘EUPAW’ – the Evaluation of the EU Policy on Animal Welfare.

EUPAW – what is it ?

Background

Within the last 30 years the EU has adopted a series of legislation concerning the protection of animals. The scope of this legislation includes the protection of animals kept for farming purposes, during transport and at the time of killing. It also includes the protection of animals used for scientific purposes. Furthermore the welfare of wild animals is part of EU legislation through a directive on zoo animals as well as initiatives prohibiting the trade in seal products from commercial seal hunts and establishing trapping standards. The EU has also banned the importation and intra-community trade of cat and dog fur.

The EU adheres to the principle that, beyond specific objectives, people have an ethical duty of taking care of animals which are under their responsibility. EU legislation in those fields reflects the increasing importance given by the public on the ethical dimension of economic activities dealing with animals. The intervention of the proper care of animals is sufficiently significant as to affect the functioning of the internal market.

In 2006, the Commission adopted the first EU Action Plan on the Protection and Welfare of Animals 2006-2010 (later called ‘Action Plan’) where strategic lines and future actions were described. The Action Plan was the first document grouping in a single text the different aspects of the EU policy on animal welfare.

These terms of reference now envisages an evaluation as to establish a follow-up programming beyond 2010.

EUPAW – Introduction

GHK Consulting Ltd and ADAS UK Ltd have been commissioned by the European Commission, Directorate General Health and Consumers (DG SANCO), to evaluate the EU Policy on Animal Welfare (EUPAW) with reference to farm animals, experimental animals, pet animals and wild animals which are kept in captivity or submitted to a treatment which is controlled by humans.

The evaluation covers four types of EU action (legislation, research, communication and international activities) and is concerned with EU animal welfare actions over the 2000-2008 period only.  An overview of EU animal welfare policy is available at:  http://ec.europa.eu/food/animal/welfare/index_en.htm.

As part of the evaluation we are keen to hear the views of stakeholders and are therefore requesting stakeholders to complete this on-line survey to assist us with the evaluation.

The survey is short and easy and can be completed in 15 minutes but allows you to spend longer and give more detailed explanations if you wish. When processing the results to the survey, all responses will be treated as confidential and not attributed to individuals or organisations.

The survey will remain open and online until Friday 31st July 2010.

Whilst we at SAV are aware that primarily, EUPAW evaluation (through the on line questionnaire) covers four types of EU action, we consider that this is an ideal opportunity to once again present information to the EU regarding our concerns for:

  • Stray animal welfare in the Balkans states
  • Stray animal welfare within the EU
  • EU accession criteria and responsibilities for nations wishing to gain membership of the EU, including implementation of the rule of law; something we do not see at all from within Serbia; even though the (Serbian) Veterinary Law of October 2005 says otherwise.  This has been backed by recent actions at the Serbian Constitutional Court.

And so today, 23/06/10, SAV has submitted lots of data and evidence to EUPAW, asking that the current illegal killing policy undertaken by many Serbian authorities be seriously considered for future EU membership by Serbia.

Serbia is not enforcing its own ‘rule of law’ with regard animal welfare for stray animals – enforcement of the law which must be shown to be implemented by Serbia if it requires EU membership.

As you can see, within this letter we have included many links to the SAV site which show animal suffering through illegal activities within Serbia.  We have also included many links to the situation in Skopje, Macedonia, as well as links covering stray animal abuses in Turkey, Greece and Romania.

As Greece and Romania are already existing EU member states, we feel that the time is due for the EU to introduce an EU wide policy / legislation relating to the treatment of stray animals.  It is hoped that our letter of today makes this clear to the EU authorities.

We are well aware through our many EU contacts that there are many organisations / NGO’s throughout the EU who are also making representations to EUPAW about the situation for stray animals both within EU member states and EU accession states.  We hope that by presenting a combined front of evidence to the EU on the treatment of stray animals in all parts of Europe, the EU has no choice but to consider this issues further.

Again, we ask that if you do mail, you please demand that the EU produces legislation for the protection of all stray and roaming animals throughout the European Union.  Please also comment that you are disgusted by the reports which are being given to you of stray animal cruelty in the Balkans states.  If an accession  nation requires membership of the EU, such as a balkans state, then it must comply with its own national legislation – the rule of law; which is NOT being done regarding animals in Serbia.  In addition, the EU is failing stray animals who have no legislation to protect them; therfore the EU needs to act, and act now !!

Honorable Officials, Gentlemen, Ladies,

Citizens all around the world are shocked and appalled.  We have heard of the horrors committed against stray animals in Macedonia and are shocked by the violence and killing of animals that happen on a daily basis in Macedonia, mainly in Skopje, in the holding facility Vardarishte.

We are shocked by the cruelty of your institutions, which are paid to deal humanely with the problem of homeless animals, to engage and to conduct the CNR program, the only successful program in the world that is appropriate for a normal and civilized country. But instead, dogs are persistently killed, neutered dogs have been caught and never released, for which there is no justification.

Thanks to the internet, the whole world already knows the stories about the concentration camp Vardarishte, a holding facility that is open only six hours a week, on Friday and Saturday from 9-12h, the whole world knows that the dog catchers, until recently, were hunters and delinquents. That they used to kill dogs on the streets, with guns and received a financial reward. They now do the same, hidden in the rooms of Vardarishte.

We know and we have seen that the animals there have hideous living conditions, we have seen that official statistical data indicates 60% dog killing, but the real bloody number is hidden.

We know and we have seen that veterinarians are engaged to kill, not to sterilize – your people are not blind and you cannot deceive the rest of the world!

The Mayor of Skopje has proven himself, like nobody before, to be cruel, brutal, blind to the sufferings of animals, deaf to the calls of its citizens.

You cannot deceive us, nor the Macedonian population, that he is not behind the killings, because he is the one who closed the facility to the public, he is the one who hired new dog catchers and killers, forbad volunteers taking pictures in Vardarishte. Let’s not lie to each other, we know it all. Shame on the Mayor! Shame on the Macedonian officials who allow these inhumane conditions and treatment of animals!

We are urgently asking for this to be stopped and that the holding facility of death to be closed, because it is a bloody stain on your city, your country, your face!

You cannot hide the truth – it is everywhere, and here we are, the advocates for animal rights, to testify in order that these unfortunate, poor souls not be forgotten!

We demand that veterinary authorities respond and close these shelters of fear, despair, disease and death. 

There can be no justification whatsoever for ignoring these facts!  There can be no justification for remaining silent!

I urge to take immediate action to put an end to these horrors.

Macedonia: Public Company “Komunalna Higiena” – Skopje, Who have Attempted to Cover Up Pound Killings for Years, Are Now Informed by the Commission That They Have to Provide Data on Dogs Taken to and Killed at Vardariste Pound, Skopje.

Dear Sir/ Madam,  

We would like once again ask for your help, because the situation with the stray dogs in Skopje and Macedonia is not improving in any way. In this letter we would like to point out all the irregularities, as well as the documents we possess and which refer to and give evidence of what is happening here, and which we believe will give you the full image of the terror.  

We would like to ask if you could help us by acting in response to this situation on your behalf once again, since in spite of all our reactions as an Association for protection of animals to all the competent authorities, and in spite the fact that we constantly point out all the irregularities through the media, still the situations is worsening, and not only that the killing of the dogs does not stop, but it continues to intensify.   

We sincerely hope that if our reactions toward the authorities are supported by You directly, the pressure will be more significant and the chances to stop the killings greater, so we may be able to change this horrid reality.

The holding facility besides being closed for the public, that is, visiting is not allowed accept for 6 hours a week, taking of photos and videos is also prohibited and the conditions are worst then catastrophic (one of the latest things that we managed to film was a dead dog in a cage which they didn’t notice for an entire day – obviously they don’t even check the cages, meaning, they don’t feed or give water to the dogs regularly), and dogs that are completely not aggressive are noted as being aggressive and set to be killed – without it being confirmed by a veterinarian! 
 

In the meantime the dogs are constantly being caught; there are 8 teams of dog catchers, whose members are extremely uneducated, inefficient and cruel (a significant number of them have previously worked in slaughter houses, or they are hunters and some of them have criminal record).  

The dogs are being brought to the facility in massive numbers and in just a day or two they disappear; and when we express interest for any of the missing dogs they reply that they have been adopted, without enabling us to learn where and by whom – we believe that they are being killed.

Even though we asked for the data that give evidence of the work done by the Holding Facility which should be public, including the records of captured dogs, the records of euthanized dogs with the signature of the veterinarian who concluded the reason why the dog should be euthanized, as well as the documents for the procurement of barbiturates – the means for humane euthanasia, we never received the answers, which indicates that the dogs are being killed arbitrarily and by God knows what means!   

Although the facility is obligated by law to disclose and deliver this kind of data, although they are obligated by the Commission for access to information of public character to officially respond to our requests, so far, they have answered by only giving us rough numbers of captured and killed dogs (falsifying the numbers of killed dogs), clearly avoiding our focus of interest – accurate statements of the motives for the killings and the means by which they were conducted.   

Enclosed is our Request for information of public character, the Response from the public enterprise “Communal Hygiene”, our Appeal upon their response which was accepted by the Commission for access to information of public character, to which they, again, did not respond.  

The same happened when another association asked for these information, but received even worst response – in a most rude and unbelievably impudent manner they were told they should not ask such questions at all, and that it is not their business to inquire! (this document is being translated and we will soon deliver it to you).

We most fervently ask you to help us and put pressure on the responsible authorities in Macedonia, since we are convinced that all of this is an organized strategy to exterminate the dogs form the streets!  

The most responsible authority is the Mayor of City of Skopje, the person who disallowed that the facility be open to visitors every day, prohibited taking of photos and filming of the captured dogs at the facility, and instead of increasing the numbers of the veterinarians who would neuter the dogs, engaged 8 teams of dog catchers. (before there were 1 or 2), procured new vehicles and equipment.   

We organized a massive protest accompanied by a request that the facility should strictly implement the CNR programme for which it was initially established, to accept and deploy volunteers, to work transparently and to disclose all the information requested by the citizens and the associations, to improve the conditions and to be opened every day for visitors who would be able to take photos whose publishing on the net would help find families for these strays.

None of our requests were put into consideration and all of them were ignored!

The Veterinarian Department within the Ministry is well informed about this situation and the horrible conditions, they are also well informed about the way the work is being carried out in the holding facility, including the conditions in which they keep the dogs and the way they treat them. In spite of this they chose not to react and to apply sanctions against the responsible personnel. Our association is constantly submitting appeals in which we report about the irregularities for which we have numerous evidence in photos and we ask the Veterinarian Authority Department to take action.  

In the meantime, the Ministry (the Veterinarian Authority Department) is drafting a Rulebook on the operations of holding facilities, shelters, and transit centers. In our opinion the Rulebook is highly inconsistent within itself and gives room for misinterpretation that is, it allows for arbitrary and subjective decisions to be made by the officials in charge of this type of facilities. One sticking example is the prescription for all three types of above mentioned facilities, that dog should be kept for no longer than 5 days, in which period the dog can be adopted, and if it is not, after the expiration of this 5 day period the dog shall be killed. This ordinance is clearly inconsistent with the CNR program. We believe that this gives alibi and practical conditions for massive extermination for several reasons:

Firstly, the holding facility currently is opened for visitors twice a week for 3 hours, which doesn’t give opportunity citizens that are interested in adopting to come into the facility at their convenience.  

Secondly the general awareness of the citizens about adopting a stray and animal welfare is still very low. It is most likely that in this situation where the problem has been neglected for decades and there are no shelters of any kind of dogs, or any transit centers for massive sterilization/castration.  

This kind of regulations will only give open way for massive and unjustified killing of unaggressive and healthy animals, which only serves the narrow interests for instant and false solution.

 and to write them a letter in which you request his personal effort to stop the killings and to perform the strategy of Catch-Neuter-Release.   

We need your assistance in order to stop this cruelty and killings.   

We are fully aware that you are an organization with great influence and therefore we ask you to put a pressure in the European institutions and European Parliament too, emphasizing that Macedonia as an aspirant to become a member country of EU as of standards and human norms in solving this problem, and not to behave in a barbarian and cruel way in the 21st century.

FREE ACCESS TO INFORMATION OF PUBLIC INTEREST

– AN OVERVIEW OF THE SITUATION.  

The Appeal of Meri Jordanovska from the city of Skopje against the Public company Komunalna Higiena – Skopje  

Commission for protecting the right of free access to information of public interest, acting on the Appeal of Meri Jordanovska from the city of Skopje against the Public company Komunalna Higiena – Skopje, related to her Request for free access to information of public interest, according to articles 28 and 32 of the Law for free access to information of public interest; on its meeting on October 27 2009 has made the following.  

 

D E C I S I O N  

Appeal of Meri Jordanovska from the city of Skopje, made against the answer of the Public company Komunalna Higiena – Skopje, in part that relates to her Request for “names and job positions of all employees of Vardariste, including those employed on a part-time basis, and the copy of the annual report of activities of this dog shelter”  is accepted, and the Public company Komunalna HigienaSkopje is ordered  to give the requested information in period of no longer than 15 days after this Decision has been delivered, in form that was asked in the Request.   

Part of the Appeal that relates to the information of “the number of dogs being killed and the way they were killed, the name of the person which executed euthanasia, and for what reason it was made – for each single dog in 2008 and 2009” is also accepted and the Public company Komunalna Higiena – Skopje is ordered to re-deliver this request to the one that has such information, in period of no longer than 15 days after this Decision has been delivered.  

 

E L A B O R A T I O N  

Commission for protecting the right of free access to information of public interest has acted on the Appeal of Meri Jordanovska No. 07-484/1 dated August 31 2008, made against the Public company Komunalna Higiena – Skopje, related to her Request for free access to information of public interest. In part in which she requests documents for “names and job positions of all employees of Vardariste, including those employed on a part-time basis, and the copy of the annual report of activities of this dog shelter” the Commission has ordered the Public company Komunalna Higiena – Skopje to give the requested information in period of no longer than 15 days after this Decision has been delivered, in form that was asked in the Request.  

Part of the Appeal that relates to the information of “the number of dogs being killed and the way they were killed, the name of the person which executed euthanasia, and for what reason it was made – for each single dog in 2008 and 2009” was also accepted and the Public company Komunalna Higiena – Skopje was ordered to re-deliver this request to the one that has such information, in period of no longer than 15 days after this Decision has been delivered.  

After deliberation on the Appeal, Request, and other files associating the Subject, the Commission has made the following Conclusion:  

Meri Jordanovska from the city of Skopje on July 1 2008 has issued a Request for free access to information of public interest, to the Public company Komunalna Higiena – Skopje, in which she writes:  

“List with names and job positions of all employees of Vardariste, including those employed on a part-time basis; copy of the annual report of activities of the dog shelter. Subject of our interest is the number of dogs being killed and the way they were killed, the name of the person which executed euthanasia, and for what reason it was made – for each single dog in 2008 and 2009; Insight in the amount of money being spent for the needs of Vardariste. We want to know how much money was spent for food for the animals, for euthanasia, and for medical treatment. What was the quantity of barbiturates purchased in 2008 and 2009 (insight in the document for purchase); Information on the name of the subject who won the public tender for medical treatment of street animals in 2008 and 2009.”  

In relation to the above mentioned Request, the Public company Komunalna Higiena – Skopje with the Announcement No. 03-9772 from July 29 2009 has informed the Request petitioner that “the period for access to the information requested will be prolonged at the most 40 days after the Request has been made”.  

In relation to the above mentioned Request, the Public company Komunalna Higiena – Skopje on August 17 2009 has also delivered a Response No. 03-8760/2 to the petitioner Meri Jordanovska.  

Dissatisfied with the answer, Meri Jordanovska on August 31 2009 submitted Appeal to the Commission, in which she states “part of the answers does not include information that was asked for in the Request”. In the Appeal, she specifies:  

“The Request comprised of information on names and job positions of all the employees of Vardariste; but the answer contained only the job positions of the employees but not  their names”.   

“In my Request it was firmly expressed my interest for the way the dogs are killed in Vardariste (if it’s with a needle injection, quotation on its type); the name of the person (not the organization) which euthanizes; as well as the insight and copies of every single dog that has been euthanized in 2008 and 2009”.   

The Commission, with letter No.07-484/2 from September 3 2009, forwarded the Appeal to the Public company Komunalna Higiena – Skopje, and made a request, in the shortest timeframe possible (immediately) to explain its stand on the issue and to deliver to the Commission all the files regarding this Subject.  

Public company Komunalna Higiena – Skopje sent a Response on the appeal No.03-9772/5 from September 16 2009, to the Commission. In the Response it is written that “the part one of the Request of Meri Jordanovska is insubstantial because the information asked actually reveals personal data information, which is violation of personal data information protection, according to the Law for free access to information of public interest.  

As for the second part of the Request, Public company Komunalna Higiena – Skopje has also stated that it is insubstantial, because “Public company Komunalna Higiena – Skopje with a letter No. 03-8760/5 from September 10 2009, has informed Meri Jordanovska that her Request relates to information that Public company Komunalna Higiena – Skopje does not possess, and she was again informed that veterinary services are performed by the institution of Veterinaren Centar DOOEL – Skopje, which was chosen after a public tender for such services”.  

In relation to all of the above mentioned in the Response, the Commission wants to point out the following:  

It is true that names are personal data information, but only by this data one can not identify certain individual, so they don’t have the same degree of protection as some other sensitive personal data information which are a whole different category and are particularly protected. For instance, in one given city there is a possibility that several citizens with the same name and surname exist, so solely on the basis of their names, one can not reveal their identity.  

For a certain individual to be identified there has to be more information that is specific only for its identity. Identity of a person can be determined directly or indirectly, especially by its National Identification Number, or by one or more specific characteristics for its physical, mental, economic, cultural or sociological identity.  

So it appears that in this case, revealing of the names of employees does not mean that it’s a violation of personal data information protection.  

In relation to the claims in the part two of the Response to the Appeal, the Commission wants to point out the following:  

Public company Komunalna Higiena – Skopje has acted in accordance with article 26 paragraph 2 of the Law for free access to information of public interest, and has informed the Request petitioner that it does not possess the information which petitioner asked for.   

Nevertheless, it did not act in accordance with article 18 paragraph 1 of  the Law for free access to information of public interest:   

If the owner of information which has received a Request doesn’t have such an information at his disposal at the moment, he must immediately resend petitioner’s Request to an institution that has such an information, and he’ll inform the petitioner for this development”.  

Because of the all abovementioned, the Commission has decided as elaborated in the disposal of this Decision.  

Against this Decision, if not satisfied, one can file a Lawsuit in a period of 30 days after its delivery.
