Lennox, the dog at the centre of an international campaign to stop a Northern Ireland council from putting him to sleep, has been destroyed.

The dog’s heartbroken owner, Caroline Barnes, said her teenage daughter Brooke had been denied the chance to say a final farewell.

“We had told Brooke that even if we don’t win (the case), she can still see Lennox, have her last pictures with him and say goodbye,” said Ms Barnes.

“To then have to tell her that no, that is not happening, it has been extremely unfair.”

The family has been told the dog’s body will not be returned but they will receive his ashes.

Last night Lennox supporters staged a protest in Spain, following similar rallies in New York and Serbia.

Ms Barnes said: “We can draw a bit of comfort from all of the brilliant friends that we have made.”

The family pet was put down this morning after the expiry of a midnight deadline for legal appeals.

Campaigners claim to have 200,000 signatures supporting a reprieve and emotions were running high.

A Belfast City Council spokesman said: “Lennox, an illegal pit-bull terrier type, has been humanely put to sleep. This was in accordance with the Order of the County Court which was affirmed by the Northern Ireland Court of Appeal.

“Whilst there is an exemption scheme to which dogs of this type (pit-bull terrier type) may be admitted as an alternative to destruction, there were no such measures that could be applied in this case that would address the concerns relating to public safety. The Council’s expert described the dog as one of the most unpredictable and dangerous dogs he had come across.

“Over the past two years, Council officials have been subjected to a sustained campaign of abuse including threats of violence and death threats. The Council has been in ongoing contact with the PSNI in relation to that.

“The Council regrets that the court action was necessary but would emphasise that the safety of the public remains its key priority.”

Lennox was impounded by Belfast City Council’s dog wardens in 2010.

In June, Northern Ireland’s most senior judges rejected Caroline Barnes’ legal bid to overturn an order for the destruction of her pet.

Ms Barnes, who is disabled, and her family insisted that Lennox was not dangerous, and while it was not clear exactly what breed he was, pit bulls and dogs like them are illegal in Northern Ireland.

Two lower courts had already ruled that the dog should be put down.

The dog was seized by Belfast City Council dog wardens in May 2010. He was assessed to be a danger to the public and subsequently ordered to be put down.

A former Metropolitan Police dog handler claimed the dog represented a danger due to his unpredictability.

Ms Barnes, 35, had accepted her pet was a pit-bull type, but claimed there had been a failure to properly consider a possible exemption scheme.

Her battle for Lennox became an international campaign to save his life. It went “viral” on social media websites and attracted tens of thousands of well-wishers.

Well-known people including boxer Lennox Lewis and Assembly First Minister Peter Robinson were among those who used Twitter to call for the dog to be spared.

Speaking today from Philadelphia Minister O’Neill said: “I am very encouraged by the news that steps are being taken to lift the beef ban which has been in place for far too long.

“Our beef industry has proven itself to be robust and has had to invest heavily to rebuild markets and secure new business over the past decade whilst the ban has been in place. The red meat industry in the north is now worth over £800million to the local economy, with the red meat processing sector employing 3,300 people.

“This move has the potential to reopen the huge US market for our local beef farmers which can only help the sector grow further.”

Again Phil has provided us with a formal CIWF statement which has today (10/07/12) been provided to Serbian campaigners to use and forward on to Serbian government Ministry officials – the very people who should be ensuring that situations like these seen at this farm never happen.

Below is a full transcript of the statement made by Phil Brooke after reviewing the recent photographs and information provided by SAV and Serbian welfare campaigners.

As Serbia is looking towards EU membership in the near future, we would like to draw attention to one particular part of the statement made by Phil; this being:

If a nation is looking at future EU membership, then it must do a lot better than to allow animals to be kept in non-EU standards.  There is no further statement to be made – Serbia needs to improve big time !

We know that conditions on this Serbian farm are not a ‘one off’ – similar conditions are regular all over the country.  We are now working with serbian campaigners to identify and expose these other facilities.

Unsanitary Conditions for Serbian dairy cattle at Rusko selo 1st July 2012

In 2010 we issued a statement relating to the environmental conditions for dairy cattle in this farm. We stated that is was clear from the photographs that these cattle were being kept in squalid, filthy, unhealthy and completely unacceptable conditions. The cattle in the pictures shown were standing in water contaminated with excrement. The matted nature of their coats shows that they were unable to keep clean and had clearly been in these conditions for some time.

We are disturbed to discover that in 2012, conditions do not seem to have improved. Pictures from the farm show the cattle lying in their own manure. Unsurprisingly, their coats were dirty due to being forced to lie in their own excrement. Contact between their udders and faeces and urine and dirt on the teats increases the risk of infection by a range of micro-organisms including e coli. These can cause mastitis which is a risk to the health and welfare of the cattle as well as to the health of people who consume dairy products from this farm.  These are also conditions in which flies are likely to breed with further risks of disease spread.

In the event of rain it seems clear that the lying area would again become waterlogged. Wet feet can lead to a range of hoof conditions and increased risk of lameness.

Cattle need a comfortable, clean and well-drained area to lie down, receive adequate rest and remain healthy. The squalid conditions these cattle are being kept in plainly fail to meet basic welfare or hygiene standards as laid down by Council of Europe Convention and EU Directive which require that animals are prevented avoidable suffering and kept in conditions which avoid risks to their health.

It is clear beyond doubt that what is shown in these photographs does not comply with existing EU legislation, and consequently could impact Serbian accession to the EU. In the event of Serbia’s accession, these photographs could form the basis of a formal complaint to be made to the Legal Affairs Dept of the EU associated with animal welfare.

COUNCIL DIRECTIVE 98/58/EC of 20 July 1998 concerning the protection of animals kept for farming purposes

Article 3

Member States shall make provision to ensure that the owners or keepers take all reasonable steps to ensure the welfare of animals under their care and to ensure that those animals are not caused any unnecessary pain, suffering or injury.

12. Animals not kept in buildings shall where necessary and possible be given protection from adverse weather conditions, predators and risks to their health.

Council of Europe Convention covering the Protection of Animals Kept for Farming Purposes state, amongst other things:

Article 9

1. Animals should be maintained in a clean condition.

2. Those parts of the accommodation with which the animals come into contact should be thoroughly cleansed, and where appropriate, disinfected, everytime the accommodation has been emptied and before new animals are brought in. While the accommodation is occupied by the animals, the interior surfaces and all equipment therein shall be kept satisfactorily clean.

The Serbian Ministry is failing Serbian animals.  Despite conditions shown above, they have informed us that we should not be pressurizing them !

This was in 2010 when the statement was made.  It is now summer 2012, and you can see how conditions have changed when they are left to work at their own pace.

URGENT PLEA FOR A PARDON/INTERVENTION TO ALLOW EXPORT OF “LENNOX” TO THE USA OR OTHER COUNTRY OUTSIDE THE UNITED KINGDOM WHERE LENNOX HAS BEEN INVITED

– SAMPLE LETTER

Dear Sir,

I am writing to you with regard to a travesty about to occur in Northern Ireland and to beg you to please intervene and help save a life.

The life in question belongs to Lennox, a seven year old American Bulldog Labrador Cross who was living happily with his family inNorthern Ireland.  On May 19, 2010,  Lennox was seized by council officials as an alleged “pit bull type” and taken to secluded kennels whilst his owner was issued a warrant of seizure with an incorrect address for another location. 

While incarcerated in undisclosed kennels, Lennox’s family has never been permitted to visit him. It is now beyond two years that his family has not had an opportunity to interact with Lennox. According to the animal behaviourists who have examined Lennox and the various pictures on public view, Lennox’s health has been very much impacted while in custody.  Lennox has lost a lot of his body fur much of it falling in clumps, Lennox has open soars throughout his body, he suffers from an injured neck, he has an unattended bleeding paw, and he is administered anti anxiety medication on a daily basis to help alleviate his stress.

In a desperate attempt to save Lennox, his owner Carolyn Barnes’s supporters have created petitions and videos resulting in worldwide support to bringLennoxhome.

Northern Ireland has yet to fully implement  the same dog legislation as in mainlandUK.  IfNorthern Ireland were to complete the same dog legislationLennox could now be at home with his family.  The USPCA stated that the law inNorthern Ireland could be changed simply and rather quickly by an order in Council.  As it is, Lennox was branded a “pit bull type” by theBelfastCity Council despite a dog license issued yearly for five years by the same City Council who seized him. 

 It must be noted that Lennox never bit or attacked any human or any other animal in all the seven years of his life. There have been two independent comprehensive assessments conducted by professional Animal Behaviourists, – Ms. Sarah Fisher and Mr. David Ryan –  both arriving at separate conclusions confirming Lennox as a harmless, friendly dog posing no danger to humans.  For further reference, Ms. Fisher has made an excerpt of her Lennox examination available to public viewing.

It  must also be added that Lennox’s owners were always thoroughly responsible in their care of Lennox. Since a puppy they had him neutered, licensed, insured, DNA registered, Pet Safe registered and micro chipped. Lennoxnever had a complaint issued against him while living with his family nor was he ever allowed to run free outside of the boundaries of the family home.

If Lennox lived in Southern Ireland where no breeds are nationally banned, Lennox would never have been seized at all. Lennoxhas been offered a place of safety with a reputable rescue in many parts of the world where he could legally live out the rest of his life.  Most recently he was invited by an organization led by the reputable dog handler Mr. Cesar Milan in theUnited States of America.

I understand that you have the power to grant a Pardon and we beg of you to do all within your power to allow Lennox the chance of life by requesting Lennox be granted safe passage to the United States of America or any other country where a rescue placement is awaiting him. 

I am sure you are aware of how emotionally committed good owners are to their pets.  Dogs are part of the families to which they belong.  In this particular case the little girl Brooke Barnes, a child afflicted with asthma and physical disabilities, was very much attached to Lennox and consistently relied and depended upon him for her safety and well being.  Please spare the owner the further trauma of destroyingLennoxso needlessly.  Please Pardon Lennox and allow a blameless animal the chance of life.

On June 20, Stilwell told Lennox supporters to “Please keep shouting out forLennox—we have the backing an amazing sanctuary and financial support to get him out—the courts know this yet they will not let him go.  Of course it would be best if he went back to his family and they will keep fighting for him just as we all will”.

After learning of the family’s statement, Monday night Stilwell tweeted, “Please, to everyone who supports @SaveLennox know that I won’t give up. I am deeply committed to him and his family”.

 On June 23, Millan had tweeted that his foundation, The Millan Foundation, “is involved in helping continue the fight to #SaveLennox”.

Lennox’s family forced to admit probable legal defeat

In a statement issued by the Barnes family, they have said that based on the advice of their legal counsel, there are simply no more avenues that can be explored through the legal system to bring their precious Lennox home to them. It is beyond comprehension the terrible anguish the family must be feeling in having to come to this difficult decision. You can read the entire statement at the Save Lennox Campaign website here, or at the link provided at the end of the article.

Over the past 13 months, I have covered the heartbreaking story ofLennoxand his family’s fight to have him freed, after being seized based on a seamstress’ tape measure back in May of 2010. Several articles have been published here about him, and each time it seemed that hope for his return to his family grew more and more dim. When the last appeal was heard, and the judge’s original ruling thatLennoxmust be killed was upheld, hearts sank everywhere. It became clear that the journey to haveLennoxcome home was running out of roads to take, and soon no more would be available. That is where the family finds themselves now.

The only option to save Lennox’s life now is if the Belfast City Councill will accept an offer to relocate Lennox to a new home in theUnited States. While the family has never refused to allow this type of relocation, they had focused their energies on trying to get him back to his own home with them where he belonged. Now that it has become clear that option can never come to pass, the hope is that at least he will be allowed to live, even if it means he cannot live with them.

An offer for a new home has been made here in theUnited States, so the decision will now be in the hands of the BCC yet again. Surely they are not so blind to all of the evaluations done onLennoxthat said that he was not a danger to anyone, and that he could be rehabilitated from his long incarceration, and become a normal dog again. While not the perfect answer, at least it would mean thatLennoxcould live out the rest of his natural life, and not have that life snuffed out with a deadly needle, with him never having known love and family again.

The Barnes family has further stated that if the BCC rejects the offer to rehome Lennox, then they will fight for the right to at least go and see their precious boy, and give him a final loving farewell. It would be beyond comprehension to think that after the months and months of battling to save their beloved Lennox, that they would be refused that one small act of compassion. But, this is the Dangerous Dog Act/breed-specific legislation that is in play here, and thousands of dogs around the world have died lonely deaths without ever seeing their families again.

We can only hope that the BCC will show mercy onLennox. This legal battle has taken a toll on the family, and it is certain they are emotionally drained, most especially now that they have to come to grips with this horrible defeat.

We must all now turn our attention to trying to somehow make the Belfast City Council see that relocation is the best option, so that this precious life does not have to end, andLennoxcan at last feel the freedom of being a family dog again.

At this point the family has stated they will provide more information soon. Right now, they are just trying to digest this bitter pill of defeat, and decide how best to proceed. Once information about how to show support for a decision to relocateLennoxis known, it will be published here.

Sweet Lennox, the laws of this world have betrayed you so badly. You have suffered for the past two years for no other reason that the way you look, and the measurements of a seamstress’ measuring tape. You have shown the entire world just how wrong breed-specific legislation and especially theUnited Kingdom’s Dangerous Dog Act really are. Even at that, it seems heels were dug in and it is you who will pay the ultimate price for this incredibly short-sighted legislation that continues to rip families apart, and take the lives of innocent dogs everywhere.

We are so sorry that our voices simply went ignored, and the unfairness ofLennox’s seizure and separation from his family has had no positive resolution. Our hearts ache that he will never again live with the family who loves him so dearly and has fought so hard to bring him home. We can only hopeLennoxsomehow feels the support that has been sent his way all this time, and knows that he is loved by people who have never even met him.

It is a shameful and dark day when a family’s beloved dog gets a death sentence such as this. It is a time when many advocates are ashamed to be a part of the human race. Defeat does not come easily to any of us. Our heartfelt thoughts go out to the Barnes family, and we stand ready to help in any way we can.

Here is some more news and photographs from Danica at Felix Shelter, regarding additional roofing problems which have now surfaced.  Please support the repair work in any way that you can – donation info is given below.

Regarding repairs, I’m copying the most important part of my blog post. 

“The roofing repairs began last weekend. There’s obviously something horribly wrong with the roof – as soon as the workers started to fix it, a hole opened in the kitchen ceiling. The entire roof structure is worn out and some of the roof rafters are half rotten.  There’s a crack in the major roof support beam which holds up the middle portion of the roof and carries the load.  Plus everything needs to be fixed before winter!

The strengthening of the roof structure will be done by installing additional support.  There is another problem with the eaves that will need to be replaced entirely. 

However, supporting the existing roof is just a temporary solution. I hope to replace the entire roof next year, thus solving the problem once and for all.”

There is always too much to do and not enough money to do it with…

All my new kitties are doing well, Alethe’s babies are getting bigger every day and Giuseppe and Klea are having the time of their lives in my backyard. Little Kami is in the house and she is already spoiled rotten.

Message: Thank you for reporting on Mercy For Animals’ undercover investigation into animal abuse at an illegal backyard slaughter facility.

I am writing to notify you of an update in the case. Roberto Celedon, who illegally butchered animals in his backyard, pleaded guilty to one felony and one misdemeanor through a plea agreement, and was sentenced to 90 days in jail.

Yesterday (June 26, 2012), he began his sentence. In addition to jail time, Celedon received 5 years’ probation.

He must pay nearly $4,000 in fines and attend 48 animal cruelty classes.

Celedon is prohibited from possessing or owning animals, operating a meat-producing facility, attending auctions where animals are sold, and selling meat products.
