The Serbian republic inspection and also the Vojvodina inspectorate have now acted and demanded that the fishes that are still surviving must be moved to the Tisa river immediately.

Whilst activists see this as some good news for the fishes that are still alive; they really feel that the actions are still not enough.

They feel that it should be demanded by the inspectorate that all the water in which the fish live should be kept at a good level fo cleanliness.  It should be declared that the persons who have caused this current terrible situation, with so many fish dying, must be made to pay for the water cleaning.  Part of the requirements also will be that a certain water level must be maintained at all times, and that oxygen must be continually provided to the fish in these areas to ensure their survival.   This can really be a natural process IF the water is kept at a good level and also very importantly, if the water is kept clean.

So at the moment a partial result; but activists still feel that not enough is being undertaken for the long term survival and upkeep of the facilities which have the fish.

Now they have yet another issue which they are attempting to get Ministry attention with.

Here again, activists have now undertaken a formal charge against the authorities.

It relates to a river, the ‘Tisa’, which is located in Northern Serbia.  The river is linked directly to a very large pond pool area which is known as the ‘Jegmec’.

There are many thousands of young and old fish in the Jegmec pool.  But very recently, loads of earth arrived in trucks and was dumped across the tributary which links the river Tisa to the Jegmec pool / pond.  Rather than be able to swim to the Tisa from the Jegmec; young fish are now unable to leave the pool as they are trapped there. 

Millions of young fish look as if they are going to die.  The weather is warm and the water level in the Jegmec is decreasing all the time.

Below you will see the demands of the Commissioner which was forwarded to the Ministry of Agriculture.  It concerns two major meat production companies.

The Commissioner has given the Ministry 5 days to respond to the requirements detailed in the letter; and if the Ministry does not act, then EPAR, the animal welfare organisation, can proceed with part 2 of its process.  Originally, in relation to this, EPAR asked the Ministry directly.  They refused to answer and so EPAR then took the issue to the Commissioner who has now given the Ministry 5 days to respond as this is an area of Public Interest.

Now all concerned wait to see if the Ministry provide a response of if they are going to ignore the request of the Commissioner also.

We have also expressed our concerns regarding dead animal corpses just being dumped on roadsides.  These carcasses provide an immediate attraction to stray animal populations, and also risk the spread of disease from the dead animal carcasses to the stray animals.  Here is a potential biosecurity problem.

As always, the Ministry wish to put the blame on the strays, when actually the problem lies with the Ministry for not taking actions to prevent this kind of this from happening.

We first had this disgusting video footage sent to us this last weekend – now we have followed up urgently and we are pleased to say that:

The police of Valjevo city have now been following up this footage – as a result they have worked with the Public Attorney of Moinica City who gave an official report of the incident on National television on 10.1.2014.  We understand that all persons involved in this incident who undertook this animal abuse and caused suffering have now been arrested and will be charged under Article 269 of Serbian law for animals.  This has a maximum punishment of 3 years in jail.

Whilst we do not expect anyone to be sent to jail for 3 years, it is hoped by us and many others that the prompt action since the weekend will send a clear message to the communities that animal abuse will not be tolerated.  If Serbia wishes to join the EU as a member state, then it really / seriously needs to address the issue of working to the good animal welfare laws which it currently has in place; rather than keep ingoring them.  We have shown enough examples on this site where the laws are just ignored for the benefit of some, whilst the animals continue to suffer.

This is a start of actions which we very much hope will now continue.

Well done the Serbian campaigners who have worked so hard with us over the last few days to get a quick and positive result.  They know who they are.

At first we were unsure what country this event had taken place in.  We consequently made contact with Serbian activists.

With their very valuable help we have now identified that this abuse of horses is taking place in Serbia; at a village known as Milavac.  http://en.wikipedia.org/wiki/Milavac

Milavac is a village situated in Ljig municipality in Serbia.

Serbian activists are now making a written charge to both the Ministry of Agriculture and also to the Ministry of Internal Policing.

This crime showing clear abuse of animals is punishable by Article 269 of the Criminal Code of Serbia.  Proof of this video has now been made as evidence of the crime, so that it can be presented to the police.  Without a hard copy of the evidence the police will dismiss this crime; and so we have to copy in onto a reliable database for safe keeping and future evidence.  If a record is not kept, the police will ignore and dismiss the evidence presented – thus the abuse will be un-recorded and the police will take no further action to investigate and punish those undertaking this abuse.

The cost of the badger cull pilots in Somerset and Gloucestershire has been put at £4,100 per badger shot, campaigners claim – and put the cost of a four-year trial at £19 million.

Animal charity Care for the Wild almost doubled its previous estimate, made in October, of £2,200 per animal, and now puts the total cost of the cull trials, which began in August at £7.3 million.

Taxpayers will pick up £5.8 million of that, with farmers paying directly to cover the direct costs of shooting the 1,771 badgers.

The figures increased after the culls were extended, with both coming to an end last month – the Gloucestershire cull being abandoned due to a failure to achieve its targets.

Charity spokesman Dominic Dyer called it “one of the most disastrous and expensive wildlife culls in history”.

He added: “This is being done to the sound of scientists almost universally saying that culling won’t have any significant impact on TB.”

Derived from answers to parliamentary questions, statistics from the Department for Environment, Food and Rural Affairs, and Freedom of Information requests, the figures out the cost to farmers who paid for the culling itself at £1.49 million. The policing bill was put at £2.66 million, made up of costs for manpower, transport, equipment and accommodation.

A further £3.17 million was attributed to costs at environment quango Natural England, the Food and Environment Research Agency and Defra, and included trapping, monitoring and data collection.

A spokesman for the NFU said: “If marksmen had been allowed to go about their lawful business, there wouldn’t have been any policing costs.”

The annual cost of bovine TB to the taxpayer has been repeatedly put at £100 by the NFU and Defra. A large chunk of this is compensation paid to farmers who had TB-infected cattle slaughtered. This reached £34 million in 2012-13, up from £30 million the year before that. The costs go further, however, with the plummeting value of cows under restriction and the huge mental strain on farmers who see swathes of their herd lost. Some of the costs to Defra are regained through the onward sale of infected carcasses.

A report from the Environment, Food and Rural Affairs Committee last year put the cost of an injectable badger vaccine at £2,000-£4,000 per sq km, with the vaccine itself expected to cost £5-6 per dose and the DIVA test (which differentiates between infected and vaccinated cattle) costing £25, in addition to existing testing costs.

In between taking calls from senior editors of national newspapers asking me if I could confirm reports that Environment Minister Owen Paterson was on a skiing holiday in France, leaving David Cameron to face the anger of flood victims, I spend some of my Christmas break getting to grips with the outcome of the badger cull pilots.

Using a number of key sources including freedom of information requests, answers to parliamentary questions and leaked documents from Defra and Natural England, I put together a picture of a badger cull that went wrong from day one and has proved a complete disaster.

To start with the free shooting of badgers at night by National Farmer Union-employed pest controllers has proved a complete and utter failure.

Despite claims by the Environment Minister that this method would deliver a quick and efficient way of killing badgers, within 10 days of the culls commencing only 90 badgers had been killed in both cull zones by free shooting.

This resulted in panic in Defra and a major deployment of Government-employed traps teams with heat seeking equipment to increase the kill rates.

At the end of the initial six weeks for each of the pilot culls, no more than 25% of the badgers killed were as a result of free shooting.

It also quickly became apparent that four monitors in two cull zones the size of the Isle of Wight was completely inadequate to gauge the humanness of the shooting operations.

As the culls progressed, wounded badgers were picked up outside of the cull zones, badgers were left overnight in cages in freezing muddy damp conditions, cages were not cleaned down between kills and the shooters found they had the wrong type of ammunition, to kill badgers at point blank range in a caged environment.

The aim of the pilot culls was to kill 70% of the badger population in each of the zones, however at the end of the six weeks trial, only 19% of this target had been achieved in Gloucestershire and 20% in Somerset.

Rather than accepting defeat, Mr Paterson played for time and faced public ridicule with the claim “the badgers had moved the goal posts”.

He then announced a shock 66% drop in the estimated badger population, which he blamed on bad weather and disease, although most experts in the field believe the sabotage of hair traps by anti-cull activists and the illegal killing of badgers by farmers and landowners was a more likely factor for the huge decline.

Despite serious concerns from Natural England’s chief scientific advisor and a number of its board members, the decision was taken extend both cull pilots.

However, the NFU contractors and government trap teams could still only reach 65% of their kill targets in Somerset after nine weeks and 39% in Gloucestershire after 11 weeks.

Also by going beyond the six week trial period, it is widely accepting by leading scientists and badger behaviourists that the trials have significantly increased the disruption to badger colonies and the risk of perturbation and TB spread.

Then we come to the staggering costs of the badgers culls which Mr Paterson has done all he can to hide from MPs and the public.

If we take account of policing costs, Government trap teams and equipment, Whitehall staff costs in Defra, Natural England and Food and Environment Research Agency and badger sett monitoring and data collection, it is estimated that the total costs of both cull pilots is around £7.3 million.

If we divide this figure by the total number of badgers killed (1,771) we are looking at a cost per badger of £4,121.

If the culls are to be extended as Mr Paterson plans for a further 3 years we can add a further £12 million to the costs giving a total figure of £19.3 million for four years of badger culling in West Somerset and West Gloucestershire.

This figure is all the more worrying, when you consider based on DEFRA estimates that even if the cull pilots were 100% successful and reduced the increase in the spread of bovine TB by 16% over nine years, this would only deliver a knock on benefit of £2.5 million to the tax payer.

So based on current projections the costs of the badger culls in Somerset and Gloucestershire outweigh the benefits by over seven times.

Taking this into account, it comes as no surprise to see Owen Paterson become as elusive as Lord Lucan since the end of the badger cull pilots, leaving his inexperienced junior Farming Minister George Eustice to take the heat in the media and Parliament, for what is increasingly seen as a disastrous policy.

Defra officials are now playing down any talk of roll out to 10 more zones in 2014 and the director general of the NFU has recently stated that even a limited extension of the culls into Devon and Cornwall in 2014, would be a bad move.

Pressure is now building for a full debate in Westminster and a further vote on any extension of the badger cull pilots.

Talks of secret reports and efforts to influence the Independent Humanness Panel behind closed doors, has also further weakened Owen Paterson’s position and credibility.

Many Tory and Liberal Democrat MPs are now becoming increasingly concerned about the growing public anger the cull has generated as thousands of protesters take to the streets of cities and towns across the UK from Manchester to Leeds and Brighton and Bristol in what is now called the “Badger Army”, which is one of the fastest growing wildlife protection campaigns in Europe.

At a time when families are seeing the biggest squeeze on incomes in over 40 years with many having to make decisions about heating or eating, this Government has delivered one of the most disastrous and expensive wildlife culls on record.

In 2014 David Cameron should listen to scientific and public opinion and stop the disastrous badger cull policy for good.

The Government must now focus on bringing farmers, landowners and wildlife protection groups together to find a long term solution to reducing bovine TB.

This new approach should be good for both farmers and wildlife and be based on tighter cattle movement controls, improved TB testing and TB vaccination for both badgers and cattle.

‘For Wildlife’, an anti-predator organization, has organized a wolf and coyote killing contest on December 28 and 29 near Salmon, Idaho.  The killing “derby” is scheduled on the 40th anniversary of the passage of the Endangered Species Act, our nation’s safety-net for wildlife, that brought wolves back from the brink of extinction. Hunt participants, in teams of two, will pursue wolves and coyotes as part of a competition for prizes, including cash awards, for the largest wolf, most female coyotes, and other categories.

Even children, as young as 10 can participate in the kill fest. 

The contest hunt will cover public and private (with permission) lands which will include lands administered by the U.S. Forest Service and the Bureau of Land Management.  Both federal agencies have regulations and policies that prohibit such commercial, competitive events without special recreation or use permits, but both agencies are allowing the Idaho contest participants to hunt on their lands without complying with federal law.

The USFS, which initially admitted that this event would require a special use permit, is now claiming that no permit is required The BLM, which admits that a special recreation permit is required, is expediting issuance of the permit without complying with federal environmental laws. 

If these agencies followed their own laws and policies, coyotes and wolves will be spared, and the killing contest will be crippled. 

Wildlife killing contest are ethically indefensible events allowing participants to kill wildlife to win prizes. 

They are biologically and ecologically reckless, not only harming individual animals, but also altering predator-prey dynamics, disrupting the social dynamics of predatory species, and increasing threats to public safety, all for ‘fun’ and prizes. 

They have no beneficial management purpose but, rather, promote gratuitous violence against wildlife.  They demean the immense ecological and economic value of predators in an ecosystem while teaching children to hate and trivialize the lives of predators.

 

‘Have gun, must kill’ – is this the American way ?

Stray Dogs population management in Romania

On 9 September 2013, the Romanian Parliament has passed a critical Law which allows the mass killing of stray dogs. This law has been validated by the Romanian Constitutional Court on 25th September and signed by President Traian Basescu. On 1 October 2013, EU Commission has written a letter to Romania to remind Romania to its international obligations, and in particular the OIE guidelines on stray dogs population management which states that killing should only be a last resort solution.

Facts

In Romania, there are estimated 60,000 stray animals living in the streets of Bucarest, and as much living in all the Country. These dogs are abandoned dogs and offspring of them.

Due to their uncontrolled reproduction and missing of common programs and standards for dog population management in the EU, the number of Stray Dogs is still increasing.

Stray Dogs are most of the time living in very bad conditions and are suffering from climate threats and starvation. Most of them are sick or injured.

Often, they suffer human cruelty, they are poisoned or beaten to death, and in some countries or regions children are using dogs as toys allowed to torture. In short: An ethically unacceptable situation in Europe.

In several Eastern and Southern European countries, where the Stray Dog problem is particularly severe, the increase of the number of Stray Dogs affects citizens’ standard of living, and leads to security problems.

As explained by the European Food Safety Authority regarding stray animals, “the establishment of high standards of animal health is an essential pillar of safeguarding public health and for ensuring animal welfare. Diseases can reduce welfare, as stress can increase susceptibility to infections and lead to animal disease (…)” (source: Oriol Ribo, The Role of EFSA in the Assessment of Animal Health and Welfare Risks from Canine Overpopulation, Conference responsible Ownership, 2010).

In view of the major public safety issue generated by Stray Dogs, citizens complain to national authorities, thus the Stray Dog issue has become a political issue.

Most governments initially decided to catch and kill the Stray Dogs to “solve” the problem. On the short time, the problem seems to be solved because Stray Dogs are not visible anymore in the street. But, on the long run, the Stray Dog problem actually increases when being killed to reduce numbers.

Legal and political background

In 1987, a convention of the Council of Europe on the protection of pet animals was established. There is no legislation on companion animals of the EU, except of a few EU rules on health and trade, also referring to dogs and cats. The legal competence is on the national, regional and even local level.

On the political European level, the first signal came from the European Council, representing the 27 Member States, that the Commission has to make some research on companion animals.

A next step was the Written Declaration n°26 of the European Parliament of 2011.

On 19 January 2012, the new Animal Welfare Strategy of the EU, where companion animals are at least mentioned, was presented.

In January 2012 the EU Commission started a science based project called CALLISTO to create a future next political and eventually legal steps. First result are expected for 2015.

The common project “CAROdog” of FOUR PAWS, Istituto G. Capporale Teramo, FVE and the EU Commission, which was launched in 2010, was however the first attempt to provide, generate and disseminate information and to share knowledge and experience about dog population and dog management and solution strategies.

Currently, some political signals are coming up on the EU institutional level and at the Member States level

The European Parliament

On 13 October 2011, the European Parliament adopted a Written Declaration n°26 on dog population management, initiated in June 2011 by Daciana Sârbu (Romania/S&D), Adina Valean (Romania/ALDE), Elisabeth Jeggle (Germany/EPP), Raül Romeva i Rueda (Spain/Greens), and Janusz Wojciechowski (Poland/ECR). This declaration, strongly supported by FOUR PAWS, was signed by more than 400 Members of the EP. It provides the possibility for the European Parliament to call on the European Commission to assess the situation of dogs in Europe, to promote identification and registration of all dogs, and require the Member States to adopt sterilisation programs for stray animals.

Even if this Written Declaration is a political declaration and has no legal character, by adopting it the representatives of the European citizens officially recognised the harm caused by the growing number of unwanted animals in Europe, have asked for solution strategies, and want the European Commission to become active in this area.

This Written Declaration has already visibly influenced national politics: on 4 January 2012, the municipality of Sofia (Bulgaria) officially announced that microchips would be implanted in all neutered Stray Dogs in the city in order to control their numbers more effectively.

Moreover, in 2012, and in 2013, the Intergroup for Animal Welfare of the EU Parliament has made to appeals threw a formal letter to the Romanian’s government not to kill stray dogs.

The EU Commission

EU Commissioner Tonio Borg has sent on 1st October a letter to Mr NICOLĂESCU GHEORGHE-EUGEN, the Romanian Minister for Health who is responsible for controlling stray dogs in Romania.

The letter aims to remind Romania to its international obligations, and in particular the OIE guidelines on stray dogs population management which states that killing should only be a last resort solution. “Kill-Strategy inefficient”: The European Court of Human Rights

On 26 July 2011, in the case “Georgel and Georgeta Stoicescu vs. Romania” the European Court of Human rights (ECHR) ordered Romania to pay a large amount of compensation to the widower of a Romanian woman who was attacked by seven Stray Dogs in front of her house in Bucharest in October 2000.

This ECHR judgement stated that Governments are responsible for Stray Dog population management and have to take effective measures to avoid overpopulation.

The court decision was based on the violation of Article 8 of the European Convention on Human Rights (respect of private life) and Article 6(1) (access to court).

The European Court of Human Rights has estimated that the Stray Dog problem in Romania is still not resolved, even if since the attack of Ms Stoicescu, Romanian authorities have adapted national legislation accordingly in order to prevent such incidents, hoping that this would solve the problems associated with Stray Dogs.

Even if decisions of the European Court of Human Rights cannot be enforced in the same way as decisions of the European Court of Justice, this case law has a moral and political impact. For the first time a State was convicted of violation of Human Rights due to a problem with Stray Dogs. And it underlines the inefficiency of the “kill strategy” adopted by Romania and several other States, municipalities more precisely.

This ECHR judgement had such an impact that recently, in Bulgaria, the Administrative Court in Sofia decided to condemn mayors to pay fines to citizens injured by Stray Dogs.

Juridical correction for animals by the Romanian Constitutional Court

On 22 November 2011, the Romanian parliament voted on an amendment (no. 912) to the Stray Dog population bill (no. 155/2007) giving every mayor the possibility to kill Stray Dogs 30 days after catching them, or on the day of the catch if the dog appears to be ill or aggressive. Furthermore, this law obstructed and discouraged dog adoption as it required citizens willing to adopt a dog to prove that they have sufficient money and space, and to provide a letter of agreement from their neighbours.

This law was infringing the general principle of Animal Welfare as enshrined in Article 13 of the TFEU.

On 25 November 2011, FOUR PAWS represented by its Romanian office, and two Romanian Animal Welfare organisations, as well as politicians across party lines, questioned the planned change in the legislation at the Constitutional Court.

On 11 January 2012, the Constitutional Court ruled that two sections of the amendment contradicted the Romanian Constitution and consequently were unconstitutional (Section 6, allowing persons to have Stray Dogs killed if they are not adopted; and section 8, which regulates the adoption process).

In a next step the Romanian Senate will have to modify the planned amendment. After that, the Parliament will vote on it again.

This is the first time that a national constitutional court has recognised that the killing of Stray Dogs is not an acceptable solution for decreasing the number of Stray Dogs.

The term “euthanasia”

Some Member States, facing the problem of overpopulation have decided to kill Stray Dogs like Romania,. These programmes are often called “euthanasia” programmes. But, as the former President of the Federation of Veterinarians of Europe (FVE) has clarified several times in public: “Bringing an animal to death without a veterinary diagnosis of an incurable disease or the impossibility to free the animal from essential pain or suffering – just to find a way to solve the problem – is not euthanasia but killing”.

The sustainable solution

It has been proved that killing healthy animals is not effective and leads to an increasing number of Stray Dogs. The World Health Organization (WHO) stated in its Expert Committee on Rabies in 1992, “There is no evidence that removal of dogs has ever had a significant impact on dog population densities or the spread of rabies. The population turnover of dogs may be so high that even the highest recorded removal rates are easily compensated for by increased survival rates…”

As Stray Dogs are not dependent on other animals of the same species to survive, any reduction in the population density through additional mortality is rapidly compensated for by better reproduction and survival.

This means that particularly in Europe, responsible ownership and the no-kill strategy provides the only sustainable solution to control and manage Stray Dog population.

As underlined by the Court of Human Rights, governments have to adopt national actions plans for reducing the number of stray animals in a sustainable way.

These action plans should consider a combination of measures such as :

*Veterinarian prevention including vaccination,

*Systematic sterilization,

*Mandatory Identification and registration,

*Educational measures for citizens,

This package should be fixed in an agreement between NGOs and municipalities (as Public/private partnership).

Soon we have elections in the EU, it would be good if Romania thinks about the political costs that brings the criminal behavior against animals. Because of this criminal behavior Romania is the most hated country in Europe, and if this massacre does not stop, the EU elections will be a much bigger disaster for the country, as the murders, which makes the land itself against the animals.

Think about it and leave the killing for the uncivilized peoples! Venus, Germany.

Please send very short PROTESTS notes against this project by which people feeding dogs, will be punished or fined and against the Mayor’s management of dogs by capturing all dogs, neutered or not, which are protected by the population, for the sole purpose of killing them.

According to the mayor of Constanta, the mass killing will start on 1.01.2014.

At the moment the dog catchers came only when they are called (they have many calls every day, as someone from the public shelter said). This mean someone call them to catch today 2 of the stray dogs we take care. We need your help to get them out from the public shelter as fast as possible and bring them to a safe place.

After making interventions in Parliament to vote on euthanasia , the Mayor of Pitesti, Mr. Tudor Pendiucviolates individual freedom , ethical rules , steps over feelings of compassion which are usual in a normal society , defies any human feelings and initiates a draft decision of the local council which has one item :

It prohibits the construction of shelters and animal feeding inside housing blocks , the green spaces around the blocks of flats or in any place in the public domain .
