In case you are not aware, we also run another site; still for Balkans animals.

No other (non Balkans) international animal issues are dealt with on BAS – it is a Balkans animals site exclusively dedicated to helping animals in Balkans states.

BAS was established due to the fact that SAV has become much more international regarding the animal welfare issues it now covers.  Whilst we welcome publicising animal welfare work across the world, the original concept of the SAV formation has now taken on a much broader and very much more international status.  So we needed to revert in some way to a specific site dedicated to only Balkans animal issues.  That site can be found at BAS.

Both SAV and BAS will continue to be updated regularly; SAV will continue to lead the way with global animal issues; and with BAS covering only those which are associated with Balkans events.

We hope you get a chance to visit BAS sometime.  The vast majority of text is the same (as SAV), the ‘posts’ are the same, but the overall layout is a little different.

Uk: Political Elections Hang Questions Over the (Return to) Hunting Issue.

For the first time in many years (25+) the Uk elections have produced no outright political party to govern the country.  The Uk is currently in a position of what is known as a ‘hung government’ – ie. No party with overall control.  At the moment, there are frantic meetings and talks going on in London between poltical parties to ascertain who can ‘do deals’ with each other and establish a government.  This system is very common in most of Europe after political elections, but is rare in the Uk.

One factor being considered by the animal welfare lobby is what could happen by these political party mergers with regard the hunting act.  Things are in the balance. 

The following is a bulletin provided by the Uk league Against Cruel Sports (LACS), one of the Uk’s largest anti hunt animal welfare organisations.

Things are moving on every hour with regard political deals – but hopefully this message from the LACS will give our non Uk friends an insight into the current situation.

Basically, the political parties view on hunting is as follows:

Conservative Party – Pro Hunt.

Labour Party – Anti Hunt

Liberal Democrats – Anti but with some pro hunt.

Message from the LACS:

Justice and prosecutions for wildlife crime now hang in the political balance. The result of yesterday’s general election shows that there isn’t a clear and overall parliamentary majority of MPs of any single party.

First and most obviously the result means that no party can point to its manifesto and claim that the majority of voters supported their policies. Put at its simplest the country voted for a hung parliament, where no one party has overall control.

From an animal welfare perspective that makes for a difficult situation in the new parliament.  The Conservative Party were committed to a free vote on repeal of the Hunting Act, the Labour Party were opposed to repeal and the Liberal Democrats said that they would establish an Animal Protection Commission to investigate abuses, educate the public and enforce the law.

All the major parties have long said that hunting is a free vote issue. Individual MPs of all parties range in view, from passionate and considered support for the ban on hunting and coursing for sport at one end of the spectrum, while others at the other end of the spectrum are passionate in their determination to repeal the Hunting Act if they possibly can. Somewhere between those two groups lie the vast majority of MPs.

Most MPs are very well aware that while a tiny minority of their voters are passionate hunters wanting them to turn the clock backwards to allow the hunters and coursers to be cruel to animals for sport, the vast majority of their electors are opposed to hunting, coursing and killing for sport.

On a free vote issue, individual MPs have to make up their own minds. The government of the day cannot use the whips to march the government payroll vote (about 130 MPs from the ruling party or group) through the lobbies and they cannot tell individual MPs how to vote, however much they might want to do so.

Individual MPs will be faced with stark choices if there is any attempt to repeal the Hunting Act. Do they follow their leader through his chosen lobby? If they follow their leaders, the majority of Labour and Liberal Democrat MPs would vote against repeal, while the majority of Conservatives would vote for repeal. If those MPs of all parties were to do what the majority of their electors want on hunting, they would vote against repeal. If MPs make their own choices the current indications are that the new parliament will be split down the middle between pro- and anti-repeal MPs. 

So the real truth to be gathered from last night is that the future of the Hunting Act now lies in the hands of 650 MPs of all parties. While the party leaders are haggling over what is and isn’t to be in the Queen’s Speech and what is and isn’t part of any agreed program for government, all of us will need to make it clear to MPs of all parties, that we do not want repeal of the Hunting Act to be on the political agenda in the new parliament. The message to the new MPs and to the hunters and to those inclined to support them, should be very clear. The peoples answer to cruelty for sport is: no, not in our name you don’t. Not with our consent do you chase and kill for sport. Animal abuse and cruelty for sport is a crime and it should stay a crime.

So the inevitable question is, what are we all going to do about it? And by us, I mean the League and all its supporters. It is clearly down to us now that the electors have decided who they want as their MPs. The election result wasn’t decided on the hunting and coursing issue. There is widespread agreement amongst the political commentators that the key issue was the desire for change. When the votes were cast and counted, a lot of seats changed hands. Some stalwart defenders of the Hunting Act lost their seats; some hunting supporters lost their seats. Some new arrivals are pro-repeal and some are against.

What the changes in the make up of the new parliament undoubtedly mean is that the hunting issue could be back on the political agenda as early as the Queen’s Speech, if it is a Conservative led government. It is also clear that the result of any free vote on repeal of the Act cannot now be predicted with confidence. It now looks as if we may well have to fight the hunting campaign battles all over again in this new parliament.

The hunters’ agenda is to ram through a Hunting Act repeal bill in the early days of a new parliament amongst a group of other repeal bills. Their plan is to get the bad news out of the way as fast as possible, and to do it in time for the next hunting season. They assume that their best chance of getting repeal is when it is too early for any sort of back bench rebellion which could bring down the new minority government. Our agenda will be to make sure that MPs free votes scupper their plans.

The hunters’ and Vote-OK goal of a Conservative led government with a sufficiently large majority to overcome the parliamentary resistance to turning the clock back to cruelty is not what the voting public have delivered. What the hunters, the Countryside Alliance and Vote-OK  will have to live with is a weak coalition of sorts, that will stand or fall bill by bill in the new minority party led parliament. By concerted action we can ensure that the Hunting Act is not repealed on a free vote.

Because there are so many new MPs, many of whom will not know about the ins and outs of parliamentary processes, and because repeal of the Hunting Act has not been anywhere near the top of the political agenda, many of the new intake of MPs will not know what repeal of the Act might mean, or how it could be achieved or stopped. It will be our job to make sure that they do know what repeal could mean to our wildlife and what it would mean to you, and that they know how to stop it happening.

As soon as the MPs are in Westminster and have email and postal addresses we will be asking you to contact them to let them know where you stand and to tell them what is at risk for hunted and coursed animals and for all those whose lives are impacted by the abusive and violent behaviour of the hunts.

The vast majority in this country do not want to turn the clock backwards to cruelty to animals for sport. Animal abuse for sport is a crime, and let’s keep it that way. When the political dust settles after the weekend’s haggling and it is clear which party will be taking the lead in parliament, we will be ready to act, with your help to help Keep Cruelty History!

Amersham horse trader loses cruelty convictions appeal

A horse trader jailed for neglecting dozens of animals at a farm has lost his appeal against his convictions.

James Gray was jailed for six months last June for leaving the animals to starve to death at Spindle Farm in Amersham, Buckinghamshire.

His wife Julie Gray, 42, and daughters Jodie, 27, and Cordelia, 21, were also unsuccessful in their appeals at Aylesbury Crown Court.

The RSPCA removed 115 horses, ponies and donkeys from the farm last January.

James Gray Junior, 17, was acquitted on two charges.

All five defendants were appealing against charges of neglect and cruelty under the Animal Welfare Act.

Judge Christopher Tyrer said: “We are satisfied that these horses were neglected and starved.

“It follows that the appellants failed to exercise reasonable care and supervision in respect of their protection and they knew or ought reasonably to have known that this would have that effect.”

The original trial heard many horses living at the farm were found surrounded by the rotting corpses of other animals which had been left to die of starvation.

Nick White, a field officer for international horse charity World Horse Welfare, was one of the first at the scene.

He said: “There were dead horses on the ground in front of me, and to the right.

“I looked across and there was a dead horse in the stalls. It was like walking into another world.”

Norfolk-based horse charity Redwings helped remove 80 animals from the farm and brought back 21 to its own care.

Redwings senior vet Nicolas de Brauwere said: “We are delighted with this result, not to mention incredibly relieved.

“As events unfolded on 9 January 2008 we found more and more evidence of untold suffering that shocked us and compelled us to act. We always believed that the evidence would support today’s verdict.”

He added: “Even though two days of rescue had already preceded our involvement we were confronted with scenes of suffering animals, animal remains, terrible living conditions and an overwhelming atmosphere of death and disease.”

In the city of Temerin, which is located near to the city of Novi Sad, a firm named ‘JKP Temerin’ operates as the garbage collection company.  In Temerin is a ‘dog and cat shelter’, given a permit for use by the Direcctor of Veterinary department of Serbia, Mr Micovic.

Serbia: ‘Tularemia’ Disease Outbreaks in Southern Serbia – Possible Cause – Too Many Rats Feeding Off Dead (Shinter Killed) Strays Left on City Dumps ?

Serbia – news has arrived which says that Southern Serbia has outbreaks / epidemic of ‘Tularemia’, which is a disease transmitted mainly by animals such as rodents.

We have been informed that this outbreak could be associated with:

  • Many of the dead bodies of dogs and cats killed by Shinters are thrown and left on city garbage dumps
  • This has created a situation where there are massive amounts of rats in these locations – these bodies being a substantial food source for the rats
  • Hunters in the regions have killed many of the foxes and wolves for their ‘sport’
  • Foxes and wolves are the main predators of the rats, and keep population levels lower
  • The natural chain of predation and food by animals such as foxes and wolves has been ruined (again) by man

The result ? – outbreaks / epidemic of ‘Tularemia’ disease, which can affect humans.

We envisage that once again it will be other animals who will now suffer.  Animals which may be rounded up and killed off – another ‘good’ excuse for the government and authorities to undertake mass animal kills; mammals and birds may also suffer as a result of pesticides now being deployed onto the ground.

Good ol’ man, you can always rely on him to intervene and destroy the natural process of animals in the process.

  

 

Serbia: Temerin City, Their Animal ‘Shelter’, Death After 3 Days and a (National) Public Attorney Who Says All Is Ok !

In the city of Temerin, which is located near to the city of Novi Sad, a firm named ‘JKP Temerin’ operates as the garbage collection company.  In Temerin is a ‘dog and cat shelter’, given a permit for use by the Direcctor of Veterinary department of Serbia, Mr Micovic.

Some very Important points to be considered: 

After three days at the ‘shelter’, dogs are taken to Novi Sad city where they are killed by ‘euthanasia’, using Pravilnik 29/94 legislation.

Prior to the new Serbian Veterinary Law of 02/10/2005, there was an old law dating from 1991 for the health protection of animals. In agreement with the old law of 1991, the authorities produced their own other ‘underlaw’ (extra law) regulationnamed ‘Pravilnik 29/94’, which was intorduced to allow the killing of animals after they were held in pounds for 3 to 7 days.

** From 02/10/2005, the new Veterinary Law Article 168 effectively destroyed everything that was written in Pravilnik 29/94, ** because the 2005 law demanded the care of animals.

Pravilnik 29/94 was overwritten by Article 168, the result being that all killing of animals was forbidden apart only from cases for Rabies infected areas, which were covered by application of Articles 64 and 65 of the Veterinary Law.

By continuing to undertake the killing of animals after 3 to 7 days in accordance with regulation Pravilnik 29/94, the authorities were then in a situation where they were working in opposition to the actual existing law

But it is very much the case, even up to the present day, where authorities are still using Pravilnik 29/94 as a reason for the killing of animals.  But in reality, Pravilnik 29/94 became nonexistent on 02/10/2005 with the introduction of the new Veterinary Law (Article 168)

Hence there should be no killing, but animal care instead.

Pravilnik 29/94 is only an ‘underlaw’ (extra law) regulation, has very less power than the actual law, and most importantly, must be in agreement with the existing lawPravilnik 29/94 was valid originally (1991 on) to protect animal health but is now in opposition to the new and current animal law – the new Veterinary Law Article 168 of 02/10/2005.

Serbian campaigners have written to the Constitutional Court saying that it is unlawful for Shinters (Dogcatchers) and also veterinarians to kill stray dogs and cats only after they have been held for three (3) days, as this is now old and outdated legislation.  Killing is forbidden under the new Veterinary law.

Campaigners have now heard from the court in writing, and they say that no analysis of the case is necessary for Pravilnik 29/94 as it has been replaced by the new Veterinary Law Article 168 (02/10/2005). 

This is exactly what the campaigners had said, ie. that the old ‘underlaw’ (extra law) of Pravilnik 29/94 was still being used when it fact it has been overwritten by the new Veterinary Law Article 168 of 02/10/2005.

In addition, Article 46 of the new Veterinary Law (02/10/2005) states that the killing of stray cats and dogs is forbidden and that instead they should be provided with care.

The word from the Serbian Constitutional (law) Court is that from 2005, animals should be provided with care and not be killed.

It would appear that all of the public firms responsible for garbage collection in Serbian cities are still working to, and effectively using Pravilnik 29/94 rather than Article 46 (168) of the new Veterinary Law

In effect, by still working to this now non existent law, these public firms who collect and kill strays are UNDERTAKING ILLEGAL WORK– they should be working in accordace with the new Veterinary Law Article 46 (168) of 02/10/2005 which demands care for the animals.

Unlike the Temerin ‘shelter’ dogs which are illegally killed after only 3 days, Cats which are taken to the ‘shelter’ do not even live three days – they are killed immediately.

Serbian campaigners have now taken this case to the court of human rights in Strasbourg – an EU court.  The caseGarbage collectors in Serbian cities are still working using the (now) non existent Pravilnik 29/94 rather than Article 46 (168) of the new and current Veterinary Law of 02/10/2005 which demands care.  In addition, campaigners have requested justification be presented for all the animal killings by the authorities from 02/10/2005 right up to the present day.

Serbian authorities  and officials are responsible for ensuring the correct laws are implemented are:

  • Mrs. Sanja Čelebićanin  -Chief of  Veterinary Inspection
  • Mr. Zoran Mićović – Director of Veterinary Department
  • Mr. Radivoje Kaurin – Chief of  Hunting – Forests Inspection.

So the situation is that many Serbian authorities are not implementing the most recent and current legislation which would give protection to animals in shelters, but are instead using old and outdated, non existing legislation (Pravilnik 29/94) as justification for the continued killing of animals held in shelters.

Another very important factor here is that what has been happening since 02/10/2005 is that existing Serbian law (legislation) has not been implemented throughout the country in relation to animal welfare.

Probably the most important point:

And the proof of the implementation of the ‘Rule of Law’ is a paramount requirement for any nation wishing to become a future member of the EU !

And so what about the ‘Shelter’ for animals at Temerin ?

We declare that the alleged ‘shelter’ at Temerin is NOT shelter but a terrible, unlawful place being funded by Serbian taxpayers to the tune of many millions of Dinars.

Is this facility simply a place that takes in public money allegedly caring for animals, whilst at the same time killing them immediately (cats) or after just three days (dogs) using outdated legislation which was replaced in 2005 ? – we think so.

Animals such as these dogs and cats which are taken from the streets by shinter teams, are not marked or identified in any way.  There is no way that the authorities can provide details of the animals taken by the shinters, be it 10 dogs or 100 dogs captured.  In effect, with no accountability of their work, these public firms can ask for as much public money as they wish – and very often / always they are provided with it !!

Can this be called ‘organised crime’ ?

If a full sterilisation, vaccination, identification and care system was established for all stray animals taken by the shinters, then the facilities such as the Temerin ‘shelter’ would be very much more accountable (ie. Record keeping) of all animals which enter the facility.

As it is, by using old, outdated, self created (mass killing) legislation such as Pravilnik 29/94 rather than working to what should be current animal protection legislation, (ie. Article 46 (168) of the new and current Veterinary Law of 02/10/2005), the authorities and those involved with it appear to in a situation where they can request, and are provided with an endless supply of public money – public money for killing animalsWHICH IS ILLEGAL (since 2005).

Serbian animal campaigners have made several criminal charges against him in the past.

By chance, Paska also lives in Temerin City (detailed above).

The photographs which you can see (above and below) in this post have been presented by Serbian campaigners to both the police and to the Public Attorney of Novi Sad, the city  near to Paska’s city of Temerin.

We have been provided with names of persons engaged in similar organised animal fights on the city of Subotica.  Animal fights which are undertaken at individuals homes.

In response to the evidence, some of which is shown here, as well as names of individuals involved and the cities in which these crimes are undertaken, the Serbian public Attorney has written to welfare activists and stated that ‘there are no elements of any crime or any criminal act’.

Because of this, and the fact that they know they are safe under the statements issued by the Serbian Public Attorney, Paska and the others continue to undertake their ‘non criminal’ acts, as you can see in the photographs.

With Public Attorney officials and police such as this, one has to ask who actually controls and heads all of this animal fighting crime ? – but then it is not a crime; campaigners presenting the evidence have been told all of this !

Implementation of the ‘Rule of Law’ is a paramount requirement for any nation wishing to become a future member of the EU !

…. And that should include Serbia; but does it ?

–          a point that we would argue given this evidence and the declarations made by the Serbian ‘legislators’ – the Public Attorney.

This data , including photographs, information and the responses of the Serbian Public Attorney, as well as the information relating to the situation at the Temerin City ‘shelter’ will now be presented to the officials of the EU.

Lets hope and trust that they take more action to fight crime than the Serbian officials and police!
