England / Serbia: Vice President of the EU Animal Welfare Intergroup Writes to EU Enlargement Commissioner Regarding SAV Concerns About the Non Implementation of Animal Welfare Legislation in Both Serbia and Bosnia Herzegovina.

Further to our recent post regarding Serbian animal fighting videos; and the animal welfare situation in Serbia generally;

we did follow up as promised and make contact with Keith Taylor MEP (for SE England) who has now helped us as always by writing to the current EU Commissioner Johannes Hahn, the top man who is responsible for the enlargement of the EU by application (accession) nations, such as Serbia.

In his letter, which can be read in full via the link below, Keith has helped us by generally dealing with the issue of the terrible treatment of strays in both Serbia and Bosnia – Herzegovina.

As we have pointed out several times on our posts in the past, Keith has again backed us and stated that as EU Accession countries, both Serbia and B-H are NOT currently upholding the EU principle of the rule of law, as well as the need that accession countries are required to fully implement EU laws into their national laws as a requirement of membership.

Keith finishes by asking Commissioner Hahn to ensure that both Serbia and B-H ‘are fastidious in implementing and enforcing their national animal welfare laws as a prerequisite to their (EU) accession’.

This letter from Keith is excellent news for us as this now gives additional support to our campaigning from the VP of the EU Animal Welfare Intergroup; as well as being a letter which is directly addressed to the man at the top of the Commission dealing with new member states applying to become members of the EU; namely Serbia and also B – H.

What Now ?

We at SAV can now follow up from this letter of Keith’s by supplying another supplement letter to Commissioner Hahn which will provide him with all the footage and links to the animal fighting videos within Serbia which can be found on, and which are given as links in some of our recent posts:

Campaign expands as 13 more bears die in Halong Bay

Animals Asia has learned that 13 more bears have died at Cau Trang Bear Farm in Halong Bay, Vietnam bringing the total death toll since November last year to 18.

It leaves Cau Trang bear bile farm – at the centre of our international campaign demanding permission to rescue the bears – with only nine remaining bears. It has also left our team shocked, sad and angry.

Having previously focussed just on Cau Trang Farm, Animals Asia is now pressing the Vietnamese government to allow it to bring all 23 remaining bears in the Halong City area to its rescue centre in nearby Tam Dao.

The campaign had received a phenomenal response having been backed by almost 100,000 supporters including celebrities such as Ricky Gervais, Dame Judi Dench, Stephen Fry and Olivia Newton John.

In the two months since Animals Asia inspected three farms in the vicinity of the World Heritage Site, 26 of the 49 moon bears – a protected species – are said to have died leaving just 23 alive in Halong City.

Animals Asia has been informed that the authorities plan to dispatch an investigation team to the province. Their remit will be to determine the cause of the deaths, whether protocol has been followed and to ascertain how the remaining bears can be saved.

Animals Asia founder and CEO, Jill Robinson MBE said:

These deaths are utterly tragic and unnecessary. It’s heartbreaking to learn that so many bears have spent years suffering on the farms, and have now needlessly died when there is a sanctuary ready and willing to give them the life they deserve.

“Through the increased local coverage of the death of these bears, Vietnam is seeing the reality and brutality of bear bile farming. While their death has shone a spotlight on the industry in Vietnam, there was no need for them to die at all.

We will continue to bring this awful cruelty to international attention and do everything we can to force the release of the remaining bears.

Bill Would End Protection for 4,000 Wolves in 4 States

A bill introduced in the U.S. House of Representatives this morning would strip Endangered Species Act protections from 4,000 gray wolves in four states and open them up to more hunting and trapping. The U.S. Fish and Wildlife Service ended protections for wolves in the Great Lakes a few years ago — and more than 1,600 wolves died as a result.

Federal judges later overturned the decisions to remove protections, but the new legislation would override those court orders and again put the fate of wolves in Wyoming, Minnesota, Wisconsin and Michigan in the hands of state wildlife agencies eager to resume their wolf-killing.

“This is an ugly political ploy that will end with a lot of dead wolves and do serious damage to one of the most important endangered species success stories in America’s history,” said the Center’s Brett Hartl. “This bill will subject some of the last remaining wolves in the lower 48 to state-sanctioned hunting and trapping seasons designed to drastically reduce populations.”

Emaciated, missing limbs, some near blind, others with open wounds, all starving – these are the animal collateral of Vietnam’s cruel bear bile industry.

Help us force the farmer who profited for years from these poor bears to hand them over to Animals Asia for urgent medical care and rehabilitation.

Sign the petition and ask the Vietnamese government to remove the bears from the farm so Animals Asia can give them the care they deserve.

Today, we and Serbian campaigners are following up on yet another serious area of animal abuse within the Republic of Serbia – namely animal fighting.

Apart from specific independent actions currently being taken by Serbian based campaigners, which we cannot give any more detail on at present; copies of the (above) videos have been forwarded to specific organisations in London for review and possible further action.

During this past week, copies of the same videos were also forwarded to the EU Enlargement Commission, specifically the Head of the department associated with Serbia’s future accession into the EU, which is currently in progress – http://ec.europa.eu/enlargement/countries/detailed-country-information/serbia/index_en.htm  , to make it very clear that Serbian authorities are NOT enforcing their own legislation – ie “the rule of law; which is a paramount and fundamental requirement for accession of any new member state (such as Serbia) into the EU.

Basically, by allowing this blatant cruelty to happen within its borders, by openly allowing it to be advertised and shown on web sites and media such as Youtube, and most importantly by not enforcing its own existing national animal welfare legislation, Serbian authorities are thus failing in their requirements to become an EU member state.

Serbian authorities have to prove to the EU that they are taking action – and we have seen nothing yet. 

In addition as further action by the welfare campaigners, on 23/1, Members of the European Parliament (MEP’s) have been contacted about this very same issue.  Through these MEP’s; we have asked them to make direct contact with:

  • Commissioner Hahn, leader of the EU Enlargement Commission

  • The Head of the Serbian section for EU Enlargement at the same Commission

  • the EU Ambassador to Serbia, who to date has failed us at every attempt to make contact regarding other animal welfare issues, such as the future for ‘Nani’ deer.

… as well as supplying them with the video footage (above) and informing them that the Serbian authorities are not enforcing their own national legislation.

We have already had confirmation by some MEPs that our request and requirements have already been viewed by them; and now we wait to see what will result as follow up actions in the coming week.

In order to become even considered as a potential EU member state; the Serbian authorities need to be fully aware that they must take full action to enforce existing Serbian animal welfare legislation; and to prevent all the things happening which are shown in the above videos for example.

Serbian authorities must be seen to be enforcing the Serbian “rule of law” within Serbia when it comes to animal abuse issues.  Unfortunately, through a lot of our other work and posts over many years, which can be seen openly on this site, , it is possible to see that the Serbian authorities are doing very little to enforce their own national legislation concerning animal welfare.

If they do not do this, then as European citizens, do we not have the right to make the fundamental statement that Serbia is NOT enforcing its own national rules of law; a basic requirement for EU membership.

This requirement is further supported by the “Responsibilities” statement made by Commissioner Hahn on his very own EU website:  http://ec.europa.eu/commission/2014-2019/hahn_en  – see the 5th bullet point – “Supporting pre-accession countries in implementing democratic and economic reforms, upholding the rule of law,”

And so, as far as we are concerned as an NGO, Serbia is NOT enforcing its own rules of law.  We see the EU Commission making it clear that it has responsibilities for ensuring that new member states DO uphold the rule of law; and we, a simple EU animal welfare NGO, continue yet again to provide the clear evidence to everyone at the EU Enlargement regarding animal abuse and cruelty within Serbia; for which very little seems to be happening as a result !

Now this latest pile of evidence has been submitted, we wait and see what is going to happen within the EU Enlargement and the EU Ambassador about all of this.

Is the EU Enlargement Commission actually going to live up to its declared responsibilities of supporting the upholding of the “rule of law” within Serbia prior to it attaining EU membership ?; or is the EU going to turn a blind eye to this animal suffering ?

More importantly; are Serbian authorities going to act relating to the existing Serbian laws by following up with actions regarding all of the footage which is shown in the videos ? – or again, are they also going to turn a blind eye and allow this to continue happening ? – blind eyes have been turned on most issues we have raised for the last 10 years or more; now we want to see positive action prior to Serbian EU membership.

The Serbian authorities have the video evidence; they know where this is happening; so why are they not acting to enforce the laws of the land and stop it ???

We wait with a great deal of interest to see what happens from all parties contacted in the coming week(s).

One thing is for sure; whatever happens or does not happen, we will report it to you, our dedicated supporters, via this site.

ABOUT THIS PETITION

Up to now, the Commission made a substantial difference between wild animals and kept animals. Unfortunately, this could now change with the introduction of the new ‘EU Animal Health Law’ which is currently being discussed in its final stage.

For the last three years, the European Commission has been drafting an Animal Health Law, which is supposed to replace and encompass most of the present EU legislation on animal health, striving for simplification and greater consistency under common principles and general rules, and under the initial draft of the ‘EU Animal Health Law’, stray domestic animals, such as dogs and cats, should have been considered ‘wild animals’.

It seemed as if, due to the voting of the MEPs in April 2014, this had been avoided and they would no longer fall under the scope of ‘wild animals’ but would be defined under a new category of ‘non-owned animals of domesticated species’. It is crucial not to let abandoned and non-owned animals fall under the category of ‘wild animals’ in order to avoid a massive eradication of them. Dogs and cats must always be considered as domestic animals, even if they are no longer under direct human control.

Unfortunately, in December 2014, FOUR PAWS European Policy Office in Brussels, reported that the proposal is presently being discussed in the last stage of the legislative process conducted through the Trialogue (which includes European Council, Commission and Parliament), and that in the present draft of the ‘EU Animal Health Law’, an opposing trend has become apparent which might now even determine the decrease of protection: the proposal tabled by the European Commission wants to consider stray domestic animals again as wild animals, despite the fact that a majority of MEPs voted against this definition in April 2014.

According to FOUR PAWS, this is happening without publicity, in the attempt to get this unacceptable definition passed without attracting criticism as it would deliberately ignore the constant requests of EU citizens to increase the level of protection granted to all animals, not to decrease it.

It is extremely important that European citizens, and compassionate people from all over the world, speak up against this  ‘two-class system’ for dogs and cats, depending if they have a family or not.

This classification is not only ridiculous, but it could lead to confusion in legal terms – to serious misunderstandings and legal uncertainty in all Member States – and be downright dangerous not only for homeless dogs and cats, but also for owned animal companions that might have got lost, or have escaped.

All in all, such an illogical distinction is scientifically wrong as it ignores the fundamental biological distinction between wild and domestic animals, and poses a serious threat to homeless animals as it would stigmatize them as ‘second class animals’. It would decrease their level of protection, ignoring the will of the European citizens who are calling for a BETTER protection of ALL animals, and it would indeed mean a major step back for the European animal welfare.

Well I am sitting here on the outskirts of Old London town in the first few weeks of December.  The last few weeks have been; well, very mild considering what a typical November day in England usually brings, namely lots of rain, snow and biting winds from the North; instead, I have been outside most days wearing just a T shirt and a very thin thermal top; watching and feeding the birds and looking at the plants and flowers, who still really don’t have a clue where they are in the year ! – I think many would point the finger at those causing massive climate change; and you can include me onto that list of names !

When I look back at this year and what has happened; I guess that there is nothing that really sticks out.  The only ‘good news’ that we can call, is the letter from the EU Enlargement Commission which arrived with us some time last week.

After discussions with some other Serbian NGO groups campaigning for better animal welfare; I think it fair to say that we consider the letter from Myriam Ferran is a very positive one for ‘our’ side.  From the day some 10 years ago when I first founded SAV, I always worked on the policy that if Serbia (one day) wishes to become a member state of the EU; then it needs to work strongly to ensure that there is much better and longer lasing applications of Serbian animal welfare laws within Serbia than they have at the moment.

Serbia already has some very good animal welfare legislation.  The main problem; and our problem as just one NGO of many campaigning for animals in Serbia, is that the laws are hardly ever enforced by the regional and national governments.  Have we not seen this clearly exposed to the world with the very recent case of Nani deer ? – legislation exists to protect her; by law, the Minister has a limited number of days in which to respond and make a decision; what do we get ? – nothing in over 2 months past the decision date ! – 2 months outside of Serbian law – is this the ‘application of the rule of law’ that new EU member states have to show is being enforced within their country before they join ?

Well now we have it clearly documented from the EU Enlargement Commission (to the Serbian government) letter that EPAR Serbia has filed a formal complaint regarding failures to apply Serbia’s own 2009 law on animal welfare.  In addition, the EU also points out that we, as NGO’s, have never received any formal responses to our written complaints from the government in the past; and that this is something which also includes our English MEP Mr. Keith Taylor who wrote to the government on our behalf also.

We were very pleased to witness that the EU also ‘encouraged’ the Serbian government to ‘engage in dialogue with NGO’s’ on the issue of improving Serbian animal welfare.  Slavica, myself and several others are happy for this to commence; after all; it is what we exist for; we now await action from the government who currently have the ‘action’ ball well and truly in their court when it comes to moving things on.  Obviously the government has a lot to go back over regarding its past failures to enforce legislation, and we do not expect immediate action.  But we do now expect action and some form of dialogue; and if this does not happen, then we will return directly to the EU to justify this.

As the letter also says, NGO’s are asking that Nani deer be returned to Mrs. Mitic for long term safekeeping.  We all hope that this will be given priority now and that very soon we can announce that Nani has been returned to the Mitic family; the very family who should never have had her taken from them in the first place !

We have been in direct contact with the EU Enlargement Commission about this; and we have been working with Serbian animal people over the last day or so to give them a crash course on the requirements of joining up as a new member state of the EU; which Serbia wants to do.  One requirement which any aspiring new member state must show the EU is that back at home, they are enforcing all of their ‘rules of law’; or national laws and legislation.

When it comes to Serbia and animal welfare legislation, we all know that the law is almost never enforced by the authorities.  So by adopting this attitude, you could say that the rule of law is not enforced and as a consequence, Serbia’s request to become a new EU member state must be put on hold until we witness ALL existing Serbian animal welfare legislation being rigorously enforced.

So you could say that at the moment it is a game of cat and mouse between the Serbian authorities and animal welfare NGO’s trying to help animals. The authorities are making threats at shelters such as Sasha’s; but we are keeping the EU Enlargement Commission (who decide who will join the EU in future) informed of things, especially the fact that the authorities are not enforcing the rule of law when it comes to adequate shelter facilities in all regions for animals.  By law, the killing of strays is forbidden, and yet the authorities refuse to accept the findings of the Constitutional Court – September 2012 – “The Constitutional Court of the Republic of Serbia – comprising 15 judges, made a verdict that the 3. Community document of Subotica (town in Serbia) regarding the matter of the treatment  stray dogs/cats is illegal; it is unlawful and it must be changed”.

So, things just go on and on; we keep up our work with all the other excellent Serbian campaigners and groups; and we hope for a positive outcome regarding many issues; especially as the EU are continually being informed of situations and what is happening.  As stated in her recent letter to the Serbian Minister of Agriculture, Ms Ferran at the EU Enlargement Commission suggests the government actively engages in ‘dialogue’ with us and other animal welfare NGO’s.  At the moment, all we see is people like Sasha being told they have 2 weeks to get rid of 450 dogs at his shelter ! – to where we ask ? – there are no regional shelters, despite what the law and courts require !!

As an NGO; we, and all the others are very happy to engage into dialogue with the Serbian authorities; but since the EU letter of early November, we have not heard a single word from them.

Finally, I wish to thank you all for your visits to the site this year; for your very supportive comments on the site; and I hope that we have given you an overview of the struggle there is at the moment for animal welfare campaigners in Serbia.
