Prijava :

da je Branka Bjelica , rep veterinarski inspektor prekoracila svoja ovlascenja  kada je  Resenjem  nalozila da pas rotvajler Bruno bude odmah ubijen , bez dokaza da je imao kontakt  s besnom lisicom , pozivajuci se neosnovano na Pravilnik koji vazi u uslovima prethodno vec dokazanog i prograsenog besnila ,kao i clan 64. Zakona o veterinarstvu koji  vazi u uslovima vec dokazanog i proglasenog besnila.

Ni jedan  opravdani razlog nije postojao  zbog kojeg bi Branka Bjelica  imala pravo i  duznost  da Resenjem nalozi da  zdrav pas Bruno  bude ubijen , ona je to ucinila u suprotnosti s vazecim propisima .

Dokazni materijal nalazi se u kosuljici predmeta  KTR 71/10, i postupajuci zamenik javnog tuzioca je  aljkavo  obavio svoju sluzbenu duznost , i , uprkos  evidentnih dokaza da je Branka Bjelica  nalozila i  izvrsitelji njenog Resenja s njom  zajedno  pocinili krivicno delo ubistva  psa   u suprotnosti s  propisima, odbio  zbog navodnog ` nepostojanja elemenata krivicnog dela ` .

Zahtevamo da  OJT Subotica pokrene istrazni postupak i omoguci sankcionisanje svih  pocinitelja i  onih koji  su do sada ometali  sprovodjenje pravde   u ovom predmetu ,a zaposleni su u OJT Subotica  kao zamenici  osn.javnog tuzioca.

u ATACHMENTU JE NASA  KP – zahtevamo da najzad korektno postupate  u ovom  kristalno jasnom  slucaju i da  zamenici OJT Subotica  prestanu   namerno nipodastavati  dokaze  ,a uzimati  u obzira izjave pocinitelja  koji   tvrde  ` majke mi radili smo po zakonu`  .  Dokazi  treba da su  merodavni , a ne  zaklinjanja pocinitelja da su radili po zakonu  za cega nemaju dokaze.

Postavlja se pitanje da li OJT Subotica  kao merilo  za donosenje meritornih odluka koristi  materijalne dokaze ili  izjave  tipa : `majke mi radila sam po zakonu` – pitamo se po kojem zakonu  , ili , ` stito sam svoje ljude`  – pitamo se od cega  je g. Mrdalj  `stitio svoje ljude`,   kada besnilo nije postojalo  ni tada ni tri meseca pre ni tri meseca posle – sto je  znala Branka Bjelica ,  i kada lisica nije  ni postojala  sto je znao g Mrdalj  kojem je smetao pas Bruno – jer nije  nadjena ni ziva ni mrtva  lisica, pa i da jeste  postojala – suma je staniste lisice  i nije neobicno da se lisica nalazi u sumi , ali kakve to veze ima   sa ` sticenjem  svojih ljudi,  ubijanjem psa `  i bacanjem  lesa u  stocnu jamu ,na kojem je insistirao g. Mrdalj. 

Zakoni postoje da bi ih svi , a narocito rep vet inspektor , komandir policije  i zamenik OJT – postovali, a ne  zloupotrebljavali ,  da bi predmet zastareo , jer

1.   delo jeste  pocinjeno- pas je ubijen –  i  to  je  nalozeno i ucinjeno

2.   u suprotnosti s vazecim propisima .

Zahtevano  istrazni postupak i  sankcije za  sve pocinitelje  koji su na bilo koji nacin  involvirani u ovo kriminalno delo .

VERY IMPORTANT – Please Read. Hunting and Timber Lobbyists in Germany May Influence EU Wide Wildlife Protection In the Future. We Must Not Let This Happen !

we now have the following report from the Lawyer who has been involved with the case working for the defence of animals.  His name is Dominik.

We need to make it clear that the following is a translation (from German to English) which has been undertaken privately and semi-professionally.  All information is as directly translated as much as possible and is legally and technically correct.  Any bolding of text or underlining has been produced by SAV – points we consider of special importance.

Dear fellow animal lovers,

comrades in arms.

Thank you for your many e-mails.

We are all shocked about yesterday’s judgement by the European Court for Human Rights concerning German hunting associations.

Verdict:

The result of this decision is that the Human rights of land owners in Germany are considered of less importance than the Human rights of land owners in France and Luxembourg (previous judgements from 1999 by the same court). In effect, this judgement represents a discrimination, because the facts of the cases are identical.

The European court was established to harmonise jurisdiction within the territory in which the European convention of Human rights applies. What we are having now is differing decisions in the member states. This judgement therefore came as a surprise to us and caught us unawares.

I think that the lobby comprised of hunters, land owners and the timber industry in Germany is far more powerful than their counterparts in France and Luxembourg.

In Germany a “cluster” for timber is under development right now that will open the flood gates to commercial forest exploitation under an ecological cloak (“Forest rejuvenation”, “Wald vor Wild” (Forest before game), “CO2 climate protection”). Both the green party as well as established environmental organisations support this concept, which, in time, is to be extended to all of Europe.

The “charter for timber” was developed by the Bavarian ministry for agriculture and forestry. The ministry is headed by Philipp Baron of (von und zu) Guttenberg (German forestry commission). This powerful lobby, which alone in Bavaria has an annual business volume of EUR 30 billion, wants to maintain the current organisational structure in the forests (meaning the hunting associations and their uninhibited access to the land) – because approx. 44 percent of the German forest is private property.

Through the hunting associations (forced membership) the majority of the land owners can thus be directed in the interests of the timber lobby. A victory for animal welfare would therefore have broken this charter for timber apart, which in Germany as in the European Union is a kind of signature issue.

Conclusion: The emphasis of the matter at hand is no longer one of hunting. It’s about immense commercial interests. It’s about an organisational principle belonging to the ruling system. And with Guttenberg & Co. we face powerful adversaries, who command, and use their influence nationally and internationally. This we have felt yesterday.

I consider yesterday’s judgement, which, with 4 to 3 (judge’s) votes, turned out very narrowly against us, for completely indefensible. I must now explain to my client that the continued access of hunters to his property to shoot hare and foxes is in the interests of biodiversity and nature conservation (art. 20 sec. GG).

In reverse this means that if those hare and foxes were not shot the consequences for biodiversity, the climate and our entire natural resources would be dire.  !!

This argumentation clearly shows that we are now living in a completely disordered world, which does no longer command either independent parliaments or independent courts of justice. We are being dominated by lobbyists, who hang on to their old systems – at whatever cost.

As yesterday’s judgement by the small chamber of the Court stands in blatant contradiction to the two hitherto pronounced against France (16:1 votes) and Luxemburg (7:0 votes) the complainant will now call on the large chamber of the European Court of Justice.

If we fail to win there we must accept that this lobby can not be beaten with paragraphs …

Then we must look for another way. And we will find it.

We now have one chance left with the large chamber.  Then we will see how big the influence of that powerful lobby on the whole court really is.

I hope and wish that we will continue to fight for our common cause and not give up now. The fight continues and the way ahead of us is long yet.

da lica koja su se i ovde,kao  sto to uvek cine ,sama predstavila ,stoga niko ne moze  reci da su NN lica ,predstavili su i sebe i svoja nedela : cine  zlostavljanje , zarobljavanje i ubijanje velikog broja  zivotinja ,kako divljih   -zasticenih  i nezasticenih , tako i pitomih , borbama  na zivot i smrt  napadajuci  i  nedozvoljeno ruseci usred zime   i u svako godisnje doba ,staniste divljih zivotinja , i  organizujuci borbe  u vestackim rovovima  u svojim smrdljivim supama i dvoristima  , kladjenja  i trgovinu   nemackim lovnim  terijerima, uz utaju poreza.

Naravno , svi  znamo da su  od  postupanja organa  zasticeni samo oni  kriminalci koji placaju `proviziju`  korumpiranom pojedincu  tog  organa .Zato ocekujemo da  organi kojima  ova dela vec bezbroj puta prijavljujemo  ,identifikuju i  izbace  iz svojih redova korumpirane  mrcine i da najzad  pohapse i njih i  ove kriminalce koji sebe  i svoja zlodela predstavljaju  javnosti  bez ustrucavanja , a  koji zajedno sa korumpiranim pojedincima u  organima vlasti  KRSE  LJUDSKA PRAVA  – koja Ustav  garantuje  i ostvaruje jedino implementacijom svih  zakona  jednako prema svima .

Zahtevamo da  organi kojima dostavljamo ovu prijavu  hitno postupe po vazecim zakonima  i da  najzad  javnost dobije obavestenje : da su  kriminalci-  ceo lanac  `jamara`  privedeni  pred lice pravde, jer  za sada  javnost  gleda samo  njihove  video zapise krvolocnih  zlodela   koja nesmetano cine prema zivotinjama  i prema ljudima koji  postuju   :  ljude  ,  zivotinje , zakone i Ustav Rep Srbije .

Posebnim aktom  : Zahtevom u skladu sa Zakonom o slobodnom pristupu informacijama od javnog znacaja,  trazicemo kopije  zapisnika  i sluzbenih beleski  o postupanju  organa  po ovoj prijavi  i o svemu  cemo uredno obavestavati javnost   Srbije i sire  – jer  ima pravo da zna .

Germany: UPDATE 23/01/11 – ‘EU Hunting Court Rulings’, the German ‘Fox Week’ and More

the message from our German animal campaigner friend finshed with the statement:

“On 20th of January we expect the decision on “forced hunting” (where hunters have the right to hunt animals on private ground) from the European Court of Justice. If that comes out in favour of our cause – which we hope – then that will be another coffin nail for the hunters and also work as a boost to our campaign”.

Well the decision has now been made by the European Court of Justice, and it has NOT found in favour of our cause.

The court’s decision for forced hunting was supplemented with a justification, and it said that the continuation of the practice is in the public interest and that hunting was necessary to protect the game stocks.

This is an Intersting twist on reality.

Going by that stated logic, and transferring it to us mere humans, any serial killer or masse murderer for that matter, would be the greatest friend of mankind we ever head. Because, in the end, by doing their killings of other humans, they, (the killer) protected the Human population.  Is it in the public interest to have the continuation of human masse killings  by serial killers to protect the human species ? – No.

 Simply one rule for the hunters and a different rule for everyone else.

Another more interesting point about the whole thing is that this very same court ruled against forced hunting in France and Luxemberg in 1999, saying that nobody could be forced to tolerate that on their private ground.

How the rules change in ten years by the very same court !

Well, the complainant (a guy from the Stuttgart area) will now go on to put his case again before the big chamber of the court; (the ruling from yesterday being by the small chamber), and we shall see with a great deal of interest what happens here.

Many people think the court decided the way it did because of pressure from the German sylviculture and the lobby behind it.  The economic value (timber prices) of German forests is high, and they are tightly managed.  Game they say, causes damage to the stock, and in many areas is seen as nothing more than ‘vermin’ that the hunters are more than, even incredibly happy, to get rid of.

Hunters are also aiming at having the (German) countys and local authorities establish bans for strollers and others wanting to use the forests for recreation. Clearly, they do not want witnesses to what they do and argue that ‘all these people disturb the game’. 

Really, is it not them who disturb the animals ? – destroying the natural reproduction cycles of animals which is based around the availability of food.  Do the hunters not put out food baits to lure their targets into the area so that they can then be shot by hunters standing high up on platforms ?

If this is not the hunting community ‘disturbing the game’, then what is ?

The hunters have currently achieved their will simply because of their connections to politics and local administrations – many hunters hold positions in these positions of power anyway.

Whatever the current situation, the campaign to stop the continued year round killing of foxes in Germany will continue.  Unfortunately, Fox Week during the next few weeks will see many, many more beautiful animals killed by hunters because of a ruling which declares that the ‘continuation of the practice is in the public interest’, that the wildlife ‘vermin’ destroy the now politically financially viable forests which the public must also be instructed to keep out of for recreational purposes !

Is the world and legislation going crazy in support of animal abusers and against the will of the majority of the public ?

–          Well yes !

It’s an early morning in Istanbul.

The Istanbul Municipality van drives through a lonely road in a village far away from Istanbul. In the back, shaken and terrified, 5 stray dogs violently hit the walls with each bump of the road. The barks and screams can be heard by every villager en route.

Upon arriving to an isolated location the Municipal drivers brutally unload the frightened animals onto the side of the road.

Two of the animals are in good condition but the other three barely have any strength to move. Mila is one of them. Too weak to move she lies on the grass, waiting to die.

We were there.

The entire event was caught on camera as part of an on-going investigation by Let’s Adopt! into the atrocities commited by Kadir Topbaş Hasdal shelter and the Municipality’s well documented practice of dumping dogs in the forests and deserted locations.

The events of that morning, together with undercover footage obtained by Let’s Adopt! proves, beyond any shade of doubt, the blatant disregard for the Law by Kadir Topbaş team and the constant and sustained lies of the Municipality to the Press and the general public.

It was barely weeks ago that the brutal killing of a cat made the entire turkish society get up in arms in rejection of animal cruelty.  The events and practices that have come to light show a different kind of cruelty, one no less brutal and affecting to a much larger number of animals, and cast serious doubts over the credibility and honesty of Kadir Topbas and his administration.

In recent months the European Union has granted the Istanbul Municipality large amounts of money in order to improve their sheltering practices, with a shelter currently being built in Istanbul with European Union funds.

European Union officials declare to be totally unaware and shocked by these practices. The scandal threatens to bring European Union funding to a halt.

Kadir Topbaş and the Istanbul Municipality deny any wrongdoing and claim the footage and the scandal to be fabrications. We let you be the judge of that.

The brotherhood and sisterhood of those who truly love animals and are steadfast in seeing conditions minimally suitable for them at the very least (if not exceeding this state) is an international one, and clearly, attention has been focused sharply on the blemish on the face of Istanbul that is Hasdal. Animals sleeping among others which are dead, injured, and / or very ill. Dogs with no alternative other than to wander among their own feces and vomit. These are the images that are emanating from the municipality over which you have been elected and given a degree of domain. It goes without saying that this does not reflect well at all on what is to be your legacy.

The video evidence clearly and unequivocally demonstrates flagrant violations of Animal Protection Law 5199 (June 24, 2004), In pertinent part: Part I, Chapter 1, Articles (a), (c), (d), (g), (h), and (j). I would respectfully suggest personal research into these matters.

Turkey prides itself on being a nation of animal lovers. It is truly my hope that the awareness currently being served upon you through various world locales prompts you to uphold the laws that are part and parcel to the government to which you were elected on the local level.

I submit this to you with the utmost respect and seriousness.

Distinguished officials from Romania and abroad

I am appalled by the daily news about about animal cruelty and crimes against animals which are committed in Romania. I am stunned to find out that in Slobozia, and in many other cities throughout Romania, the local authorities are UNWILLING to apply the Laws for the Protection of Animals from 2008 which BOTH prohibit the euthanasia of healthy animals and the International treaties and conventions which entered in force in your country after 2004….which also ban the killing of healthy animals…

Please read the following in Romanian :

“1. Conform art.7¹ din Legea 205/2004 privind protectia animalelor, cu modificarile si completarile ulterioare : „Este interzisă eutanasierea câinilor, a pisicilor şi a altor animale, cu excepţia animalelor cu boli incurabile, constatate de medicul veterinar”

Deci, nu se eutanasiază decat animalele cu boli incurabile, nu cele sanătoase, şi numai pe baza unor diagnostice precise (proba bolilor incurabile) şi incontestabile.

2. Conform :

Anexa 1

din OUG 155/2001 privind programul de gestionare a câinilor fără stăpân, cu modificările şi completările ulterioare, sunt prevăzute

a) „CONDIŢII MINIME pentru funcţionarea unui adăpost pentru câini”

b) „Spaţiile pentru adăpostire şi pentru intervenţii medicale”

c) „Controlul bolilor”

d) „Hrănirea câinilor şi curăţenia adăposturilor”

e) „Vehiculele”

Anexa 2 sunt prevăzute „NORME privind capturarea şi transportul câinilor”

3. Anexa 3 „EUTANASIEREA CAINILOR”

1. Se recomanda pentru a fi eutanasiati cainii care nu au fost revendicati sau care nu au putut fi adoptati.

(acest punct este inoperabil prin aparitia prevederileo art.7¹ din legea 205/2004 (modificata prin Legea 9/2008)

Eutanasia se recomanda, de asemenea, in cazul cainilor care prezinta boli cronice incurabile.

2. Eutanasierea cainilor se efectueaza de catre un medic veterinar.

3. Eutanasierea cainilor se realizeaza numai prin utilizarea barbituricelor, injectate intravenos numai dupa pierderea cunostintei cainelui indusa prin anestezie. Cainii vor fi asistati pana la constatarea decesului.. Barbituricele nu trebuie sa fie injectate pe cale intramusculara sau subcutanata. Pentru cainii nou-nascuti calea de administrare care se utilizeaza este cea peritoneala. Produsele narcotice pot fi administrate si pe cale orala.

4. Medicul veterinar este singura persoana care poate avea acces la barbiturice si care poate decide in privinta utilizarii medicamentelor periculoase

The international public opinion is outraged and I will inform all international authorities, family and friends about the daily massacres of animals (mostly strays) and the cruelty against animals which most of the time is not even investigated by the police, let alone punished by a judge…Romania has become known as the Hell of the EU for the animals….and I will refrain from visiting and I will ask all my acquaintances to do the same.

Please take all the necessary measures to stop the killings and to SEVERELY PUNISH ALL THOSE WHO HAVE BROKEN THE LAW…regardless of their social status.
